HomeMy WebLinkAboutMINUTES - 06181985 - 2.2 TO: BOARD OF SUPERVISORS FROM: PHIL BATCHELOR Contra County Administrator Costa DATE: June 5, 1985 Wuqy SUBJECT: REPORT FROM COUNTY ADMINISTRATOR ON USE OF BAY MUNICIPAL COURT JUDGES TO ISSUE TEMPORARY RESTRAINING.ORDERS IN DOMESTIC VIOLENCE CASES SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION: Accept report of County Administrator on the use of Bay Municipal Court Judges to issue temporary restraining orders in domestic violence cases. REASONS FOR RECOMMENDATION/BACKGROUND: By Board Order of May 21, 1985, your Board requested this Office to discuss with the Superior Court the possibility of the assignment of a Superior Court Judge to West County or to explore the possibility of Municipal Court Judges issuing temporary restraining orders in domestic violence cases. Because of a vacancy on the Superior Court bench which has only recently been filled, it will be November of this year before the Superior Court can allocate a Judge in Richmond. In the past, this Superior Court Judge has handled some family matters such as the issuance of restraining orders in domestic violence cases and the holding of hearings in these matters. Currently, according to the Superior Court Administrator, there are approximately eight restraining order hearings per week from West County that are set, but only about one ends up being heard. With the absence of the Superior Court Judge from Richmond, for the above-cited reason, a delegation was made so that Municipal Court Judges in the Bay Court can issue temporary restraining orders. This is currently being done by those judges. The Superior Court at this point cannot assign a Judge to Richmond until November of this year and believes that the delegation of this authority to Municipal Court Judges is of great assistance in enabling temporary restraining orders to be issued in a convenient manner.
