BOARD OF SUPERVISORS Contra FROM: Phil Batchelor, County Administrator Costa DATE: June 4, 1985 County SUBJECT: Legislation: AB 1791 (Cortese) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) $ BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position in support of AB 1791 by Assemblyman Dominic Cortese which would establish a simplified system by which local governments would be reimbursed for State-mandated costs. BACKGROUND: Under current law, a local government must submit a claim each year for State-mandated costs resulting from statutes which mandate a new program or an increased level of service of an existing program in cases in which it believes that the existing appropriation for this purpose does not adequately cover the actual costs of the State mandate. These claims must be submitted each year for each such State-mandated program. AB 1791 would authorize the Commission On State Mandates to establish a State Mandates Apportionment System under which programs included in the System could have reimbursements for the past three years averaged and adjusted by a specified price deflator and have future payments based on that average, adjusted each year by the deflator factor. It would no longer be necessary for local governments to submit claims in order to receive reimbursement for those programs included in the System. For newly mandated programs, local governments would have to submit claims for the first three years, following which the program could also be included in the System. AB 1791 contains an urgency provision and, thus, would be effective upon signature by the Governor. AB 1791 is scheduled to be heard in the Assembly Ways and Means Committee on June 12, 1985.
