Adopted this Order on May 7; 1985 by the following vote:
AYES: Supervisors Schroder, McPeak and Fanden
NOES: None
ABSENT: Supervisors Powers and Torlakson
.ABSTAIN: None
SUBJECT: Waiving Ordinance Code Section 94-4.414, Subdivision MS 55-83,
Deer Valley Area.
IT IS BY THE BOARD ORDERED that the requirement for consent
to dedication of public roads over existing easements of record, as set
forth in Section 94-4.414 of the Contra Costa County Ordinance Code,
is WAIVED for Subdivision MS 55-83, Deer Valley area.
The applicant was unable to obtain the consent of the owners of
easements over the existing easements of record along Deer Valley Road.
The waiving of this requirement will not have an adverse effect
on the County's interests in the right of way being dedicated to the
County. ,
