SUBJECT: Legislation: SB 1241 (Russell)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in support of SB 1241 which declares that in
the area of Occupational Safety and Health, any regulations or
rulings which exceed the requirements of federal law constitute
a State-mandated local program for which local government must
be reimbursed.
BACKGROUND:
SB 1241 is sponsored by the County Supervisors Association of
California. The bill is scheduled to be heard in the Senate
Industrial Relations Committee on May 1.
The State Constitution already requires that the State
reimburse local government for State-mandated local programs.
SB 1241 specifies that in the area of Occupational Safety and
Health the measure of what is State-mandated is anvthing which
exceeds the requirements of federal law. This does not imply
that any regulations or orders which exceed federal law are in
any way excessive or inappropriate.
It does, however, require that if the State wishes to issue
regulations or orders which exceed federal law, and which
impact local government, that the State recognize that they
have to pay for those mandates.
SB 1241 appears to be consistent with the Board' s position on
State-mandated programs and should, therefore, have the Board's
support.
