RAINEY, Sheriff-Coroner COntra Costa DATE: May 14, 1985 County SUBJECT: ORDINANCE —REGULATION OF OPEN C0 TAINERS OF ALCOHOL SPECIFIC REQUEST(S) OR RECOMMENDATION(S) A BACKGROUND AND JUSTIFICATION RECOMMENDATION: Introduce ordinance regulating open containers of alcohol within the unincorporated area of the County, waive reading, and fix date for adoption. FINANCIAL IMPACT: No significant financial impact is anticipated. The ability to issue citations that would be authorized by the proposed Order may result in .5 increase in revenue which is not possible to estimate at this time. REASONS FOR RECOMMENDATION/BACKGROUND: During the past few years, there has developed a popular ritual of individuals purchasing alcoholic beverages at retail establishments and then socializing in the parking lot while consuming those beverages. . This conduct has generated numerous complaints from businesses and patrons alike. In 1983, the State legislature enacted Penal Code Section 647e which allows cities and counties to adopt ordinances against allowing individuals possessing open receptacles of alcoholic beverages in, about, or on the parking lot adjacent to a retail package off-sale alcoholic beverage licensee. The proposed ordinance provides the Sheriff the statutory tool , necessary- to address this problem.
