Aiello, Fire Chief Riverview Fire Protection District Costa DATE: May 14, 1985 County SUBJECT: Fire Hazard Abatement Contract for Exterior Hazard Control by Tractor Drawn Equipment and Bulldozing SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: : 1. Terminate the existing three-year contract with Todd Sanders in the 1985 adjusted face amount of $79,936.74, titled "1984-85-86 Abatement Contract for Exterior Fire Hazard Control by Tractor Drawn Equipment and Bulldozing". 2. Approve and authorize the Chair to execute on behalf of the District, a new contract with Todd Sanders in the face amount of $35,000 for the period May 22, 1985 through December 31, 1985, for Exterior Fire Hazard Control by Tractor Drawn Equipment and Bulldozing. II. FINANCIAL IMPACT: No financial impact. The contractor is paid for work actually provided, and the.nistrict recovers the. cost from property owners. III. REASONS FOR RECOMMENDATION: Todd Sanders is unable to procure the required bonds in the face amount of the existing contract for this year. However, he will be able to procure the proper bonds at the new contract price of $35,000. The change to a new contract will allow Todd Sanders to continue to work for the District. The District will benefit from this change, in that it will continue to use Todd Sanders who was the only bidder on the existing contract, and his work is known. Todd Sanders has agreed to forego a 5.9% increase he would otherwise have received, and he further agrees to work at a new, lower negotiated price. IV. BACKGROUND: The District is in the second year of a three-year contract with Todd Sanders for exterior fire hazard control. Although the contract was written for a three-year period, Todd Sanders was allowed to provide bonds to the District for faithful performance, and payment for labor and materials, on an annual basis. In the first year of the contract, Mr. Sanders was late providing the bonds, so it was anticipated he may be late this year. However, Mr. Sanders has notified staff he is unable so far, to provide the required bonds this year in the face amount of the contract. The fact that Mr. Sanders is unable to provide the District with the required bonds places him in breach of contract, and requires the District take action. District staff has evaluated several alternatives and concluded the recommendations made in Section III to be the most reasonable given the present situation. (continued) The situation is that the District has notified approximately 2,600 property owners of a potential problem this year. The District Fire Commission has held a public meeting on the matter, taken public testimony and set a deadline of April 28, 1985 for self-abatement. It is now past the deadline and the District should proceed to abate the hazards where individual property owners have not complied. Todd Sanders has performed well for the'District through the first year of-.thp' . contract. District staff is willing to continue working with Todd Sanders and::.
