SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Adopt a position of opposition to AB 1749 by Assemblywoman
Mojonnier which would transfer responsibility for monitoring
Methadone programs from the State to the County without
providing any appropriation to cover the cost of such
monitoring.
BACKGROUND:
Under existing law, the State Department of Alcohol and Drug
Programs is required to finance and monitor Methadone programs.
AB 1749 has been introduced by Assemblywoman Mojonnier to
eliminate that requirement and, instead, impose a
State-mandated local program by requiring counties to review
and monitor Methadone programs. AB 1749 provides that the
county may charge and collect a monitoring fee up to the actual
cost of providing the monitoring. However, since, at least in
this County, the major Methadone programs are either operated
by county employees or on contract with a private corporation,
the provision for assessing a fee does not seem workable or
appropriate since the County would simply have to increase the
contract payment limit by the amount of any fees being charged
for monitoring the program.
In the absence of a more secure method of reimbursing a county
for the administrative costs required by this program, it is
recommended that the Board oppose AB 1749.
The Drug Abuse Advisory Board also recommends that the Board
oppose this bill.
