SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of opposition unless SB 921 is amended.
BACKGROUND:
SB 921 would require instruction in elementary and secondary
schools on drug education. These programs would be financed
under the provisions. of SB 921 by imposing a $100 drug program
fee for every person who is convicted of an offense involving
controlled substances, and for each such separate offense in
addition to any other penalties prescribed by law.
SB 921 would also impose State-mandated local programs by
requiring county treasurers to maintain a drug program fund
into which the $100 drug program fees would be deposited and
from which the expenses for the drug education programs in the
schools would be financed.
The Drug Abuse Advisory Board recommends opposition to SB 921
on the basis that a $100 fee for each conviction for every
individual convicted of specified drug offenses is unrealistic.
The Advisory Board, however, supports in concept the proposal
to raise revenues from drug crimes. This office concurs with
the recommendation of the Drug Abuse Advisory Board that a $100
program fee, in addition to all other fines , is probably
unrealistic, particularly in view of the fact that many persons
convicted of controlled substance violations do not have large
amounts of money.
If the bill were amended to provide some type of sliding scale
based on income, it would appear to be a more realistic
approach. However, our office also recommends opposition to
the bill on the basis that it establishes yet another separate
fund, with the fines and forfeiture revenues being dedicated to
a specific program. We have a general opposition to such
separate funds and to dedicating individual sources of revenue
to particular programs , believing instead that such revenue
should be general revenue available at the Board of
Supervisors ' discretion for expenditure for any program.
