The Board of Supervisors, as the governing body of the Contra Costa
County Flood Control and Water Conservation District, RESOLVES THAT:
The Contra Costa County Flood Control and Water Conservation District
has previously acquired property rights for flood control and access purposes as
described in the Easement recorded on November 8, 1961 in Book 3990, Page 501,
Official Records of Contra Costa County and as described in the Quitclaim Deed
recorded on February 25, 1985 in Book 12198, Page 156, Official Records of
Contra Costa County. A portion of said property rights are described in Exhibit
"A" attached to this Resolution.
Peter M. Hinton, Leo H. Schell , et ux., and Robert J. White, et ux., are
the owners of Parcels 1, 2, 3, 4 and 5 as shown on that certain map of Subdivision
5385 recorded on November 7, 1980 in Volume '247 of Maps, at Page 13. Said
property owners have requested that the property rights described in Exhibit "A",
owned by the District be exchanged for an easement of comparable value to be
conveyed by said property owners. The easement offered in exchange is described
in Exhibit "B" attached to this Resolution.
Upon approval of this exchange the property rights described in Exhibit
"A", now owned by the District will no longer be necessary for District or other
public purposes and the Board so FINDS. The County Principal Real Property Agent .
reports that the value of the property rights now owned by the District does ,not
exceed $10,000 and the Board so FINDS.
The Board hereby APPROVES the exchange of property rights described in
this Resolution, and the Chairwoman of the Board is AUTHORIZED to execute a
Quitclaim Deed on behalf of the District releasing the property described in
Exhibit "A".
The Board hereby DETERMINES this exchange is not subject to the California
Environmental Quality Act (CEQA) pursuant to Section 15061 (b)(3) of Chapter 3 of
the CEQA Guidelines as it can be seen with certainty that there is no possibility
that the activity may have a significant impact on the environment. This activity
is also exempt from mandatory referral for General Plan conformance, and the Board
so FINDS.
The Grant of Easement for the property described in said Exhibit "B" from
Peter M. Hinton, Leo H. Schell , et ux. , and Robert J. White, et ux. , is hereby
ACCEPTED and the Real Property Division is DIRECTED to have said document,
together with a certified copy of this Resolution, recorded in the Office of the
County Recorder.

A portion of Lot 2 as shown on the map entitled "Map of the Hemme Subdivision of
what is known as the Ford Tract in Rancho San Ramon", which map was filed March
4, 1895, in Volume C of Maps at page 71, Official Records of Contra Costa County,
California.
More particularly described as being a portion of Subdivision 5385, a map of
which was filed November 7, 1980, in Volume 247 of Maps at page 13, Official
Records of said County. Bearings are based on the California Coordinate System
Zone III.
Parcel X56A: (Quitclaim of existing F.C.D. access easement)
All of that parcel of land granted to Contra Costa County Flood Control and Water
Conservation District as "Access Easement Parcel 56A", recorded November 8., 1961,
in Book 3990 at page 497, Official Records of Contra Costa County.
Containing 8,500 square feet, more or less.
Parcel X56C: (Quitclaim portion of Offer of Dedication by Subdivision 5385)
A portion of that parcel of land shown as "Contra Costa County Flood Control
Drainage Easement" on the map of Subdivision 5385, filed November 7, 1980, in
Volume 247 of Maps at page 13, Official Records of Contra Costa County, -more
particularly described as follows:
Commencing at the most westerly corner of Lot 5, Subdivision 5385 (247 M 13.) ;
thence along the northwest boundary of said Subdivision, North 53025156" East 50
feet, to the true point of beginning; thence continuing along said northwest
boundary, North 53025 '56" East 191.11 feet; thence South 18039'04" East 16.82
feet; thence South 53025156" West 183.44 feet; thence North 36034'04" West 16
feet to the point of beginning.
Containing 2,996 square feet.
