NOES: None. ABSENT: None. ABSTAIN: None. SUBJECT: RESOLUTION NO. 85/248 In the Matter of: ) Opposition to ) SB 1091 (Campbell) ) WHEREAS Senator William Campbell has introduced SB 1091 ; and WHEREAS SB 1091, as amended in the Senate Appropriations Committee on May 6, would provide property tax revenue to two "no property tax" cities in this County at a rate of 10 cents per $100 of assessed value and, further, would increase the property tax revenue of six other cities to a level of 10 cents per $100 of assessed value; and WHEREAS this property tax revenue would be transferred to these cities at the expense of: the County General Fund and numerous special districts, including fire, library, and recreation services; and WHEREAS SB 1091 would divert some $3 . 9 million in property tax revenue from Contra Costa County and special districts in this County to these cities, thereby undermining and diluting the single most stable source of revenue available to counties ; and WHEREAS Senator Campbell has proposed in SB 1415 to replace this loss of property tax revenue with an increase in motor vehicle in-lieu revenue which is totally under the control of the Legislature, and which can be removed from the counties by the Legislature at any time; and WHEREAS by double-joining SB 1091 to SB 1415 Senator Campbell has risked a veto by the Governor thereby placing in jeopardy the increased motor vehicle in-lieu revenue contained in SB 1415 which would benefit all counties and cities in the State; and WHEREAS Contra Costa County recognizes that a persuasive argument can be made by the no-property tax cities that they do not currently benefit from new developments within their cities unless they utilize the device of a redevelopment agency; NOW, THEREFORE, BY IT BY THE BOARD .OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA RESOLVED THAT: The Board of Supervisors respectfully petitions the members of the California State Senate to vote "no" on SB 1091 when the bill comes to a vote on .the floor of the Senate, and to vote to unjoin SB 1415 from SB 1091 and then to vote "aye" ,on SB 1415; and RESOLUTION NO. 85/248 '_—.._.- -...,.2.r�.e..Q.n;.rr...xs:.;Fn+r-_ys.�.:l.S'=-c'riC:Y.•'dt?[c;'R;-:�'£`� _ .->:: - fi Page 2 BE IT FURTHER RESOLVED that as an alternative to voting "no" on SB 1091, the Board of Supervisors respectfully petitions the members of the California State Senate to vote "aye" on amendments to SB 1091 offered by Senator Robert Presley which will exclude from the property tax transfer provisions of SB 1091 any city which currently has a redevelopment agency, and which will limit the property tax transfer to a negotiated portion of future increments in the property tax, leaving intact the property tax'.base for use by local agencies which currently receive and depend on that property tax revenue. PASSED by unanimous vote of the Board Members present on this 14th day of May, 1985.
