THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on May 14 _1985_ , by the following vote:
AYES: Supervisors Powers , Schroder , McPeak, Torlakson and Fanden
NOES: None
ABSENT: None
ABSTAIN: None
SUBJECT: Application for rezoning 2623-RZ and Development Plan
3004-85 filed by J. Ronald Findleton (applicant) and
Vernon E'. Sutton (owner) , Pacheco area.
This being the time for hearing the recommendation of the
County Planning Commission on rezoning application 2623-RZ to rezone
.43 acre of land in the Pacheco area from Single Family Residential
District (R-6) to Limited Office District (0-1 ) , and for
Development Plan 3004-85 for an office building, filed by J. Ronald
Findleton (applicant) Vernon E-. Sutton (owner) .
Harvey Bragdon, Assistant Director of Community
Development , described the property site and advised a Negative
Declaration of Environmental Significance was posted for this
project .
The Chairwoman declared the hearing open. Mr . Ben Cheng ,
12 Crosby, Pacheco , appeared and expressed concerns with respect to
traffic and requested a stop sign on Aspen Drive .
Mr . Bragdon advised that the traffic pattern will be
addressed .
No one else appeared to speak on the matter . The Chair
declared the hearing closed .
As recommended by Supervisor McPeak, IT IS BY THE BOARD
ORDERED that rezoning application 2623-RZ and Development Plan
3004-85 are APPROVED subject to the conditions imposed by the County
Planning Commission as set forth in Exhibit A attached here to and
by reference incorporated herein.
IT IS FURTHER ORDERED that Ordinance Na. 85-38 giving
effect to the aforesaid rezoning is INTRODUCED , reading waived and
June 4, 1985 is set for adoption of same .
In approving the aforesaid applications , the Board concurs
in and makes the findings as shown in the County Planning
Commissions Resolution Number, 16-1985 .

CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3004-85:.
1. Development shall be as shown on plans submitted with the application dated
received-by the Planning Department February 1, 1985.
2. Provide for a sideyard of not less than ten feet measured from the inset between
windows of the proposed building to the west boundary of the property.
. 3. The applicant shall further reviewthe feasibility of providing an additional parking
space by fronting three parking spaces on Aspen Drive with more landscape area at
the street intersection. A clear 28 foot back-up and manuevering, additional separa-
tion between parking and the entrance driveway, and low decorative fence or wall
screening of parking fronting Brown/Dalton Drive should also be considered.
4. Variances are approved to have less.than the required sideyard, to have less than the
required parking, to have less than the dimensional requirements for six parking
spaces for compact cars, to have parking overhang of landscaped areas and to have a
combination eight foot high retaining wall (two feet) and fence (six feet) being six
feet high to adjacent properties. They meet the requirements of Section 26-2.2006.
5. The landscape plan submitted with the application is approved. Prior to the issuance
of a building permit a final landscape and irrigation plan shall be submitted for
review and approval by the Zoning; Administrator. Landscaping shall be installed
prior to occupancy. Care shall be taken not to damage roots which would endanger
trees on adjacent properties.
.6. Prior to issuance of a building permit, building elevations and exterior colors shall be
subject to review and approval by the County Zoning Administrator. The roofs and
exterior walls of the buildings shall be free of such objects as air conditioning
equipment, television aerials, etc., or screened from view. The trash enclosure shall
be suitably screened from the street or be relocated.
7. All signs shall be subject to review and approval by the County Zoning Administrator
prior to installation. A maximum of one low project freestanding sign is approved by
this permit. The freestanding sign shall be setback so that drivers of vehicles will
have an adequate veiw north as they enter Aspen Drive.
8. Exterior lights shall be deflected so that lights shine onto applicant's property and not
toward adjacent properties nor shall they cause glare visible from any adjoining
public roadways.
9. If archaeologic materials are uncovered during grading, trenching or other on-site
excavation, earthwork within 30 meters of these materials shall be stopped until a
professional archaeologist who is certified by the Society of California Archaeology
(SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity
to evaluate the significance of the :find and suggest. appropriate mitigation measures,
if they are deemed necessary.

10. Comply with the requirements of the Public Works Department as follows:

E. 'iiti;ate the impacts of traffic from this develoompnt hv:
1. Prior to issuance of a building permit, contribute ?6,364 to the.
Countv Trust Fund (81.9200-0800) designated for traffic imorovements
in the ='acheco area. Upon adoption of a road fee ordinance in
this area, these funds will he credited towards the suh,iect
proDerty.
OR, at the developer's option,
2. Construct off-site roars improvements in the Pacheco area as
directed by the Public Works Department.
The following statements are not conditions of approval. However, applicant should be
aware of them prior to requesting building permits.
A. The Building Inspection Department, Grading Division:
1. A grading permit may be required for the earthwork necessary to develop all
parcels in the above development plan.
2. Submit four (4) copies of plans showing the existing contours, the extent of the
proposed grading, drainage improvements and general site development.
3. Prior to the issuance of building and/or grading permits a preliminary soil
investigation report, prepared by a licensed soil engineer will be required. It
shall report on the ability of the site to support the improvements anticipated,
and shall include recommended foundations designs to achieve maximum stability
of the proposed structures. — --_
