Evidentiary Hearing Decision
This being the time set for hearing the appeal filed by
Olasheni Agbabiaka , 48 - 17th Street , Richmond 94801 , from an adminis-
trative decision of the Appeals and Complaints Division of the
Social Service Department;
Jewel Mansapit , General Assistance Program Specialist ,
Social Service Department , appeared before the Board and advised
that the Social Service Department had reviewed Mr . Agbabiaka's case
record and found that he had not been sent adequate notice of the
termination and therefore proposed to rescind the termination action
apd restore Mr . Agbabiaka' s General Assistance .
IT IS BY THE BOARD ORDERED that the public hearing is
CLOSED , and no further action needs to be taken by the Board .

SUBJECT: Appeal of D K Associates (Applicant) and Vine Hill
Business Park (Owner) from decision of Board of Appeals
requiring construction of frontage improvements as a
condition of approval of MS 75-84, Vine Hill area
This being the time for hearing on the appeal of D K
Associates (Applicant) and Vine Hill Business Park (Owner) from
decision of Board of Appeals requiring construction of frontage
improvements as a condition of approval of MS 75-84, Vine Hill area;
and
Harvey Bragdon, Assistant Director of Community
Development , described the property site and advised that the appli-
cant desires to execute a Deferred Improvement Agreement and defer
the required frontage improvements , but that the Public Works staff
recommends that the improvements be done at the same time as the
adjoining parcel on Pacheco Boulevard because of heavy vehicular and
pedestrian traffic .
Dave Jewett , Assistant Public Works Director , commented
that the Public Works Department would be willing to execute a Road
Improvement Agreement along with the subdivision agreement for
MS 75-84, with the understanding that the improvements will be made
at the same time as the improvements for Development Plan 3004-85.
The Chairwoman declared the public hearing open. No one
appeared. The public hearing was closed .
As recommended by Supervisor Fanden, IT IS BY THE BOARD
ORDERED THAT the appeal is DENIED and MS 75-84 is APPROVED with con-
ditions as set forth in Exhibit A attached hereto and by reference
incorporated herein, with the understanding that the County will
accept a Road Improvement Agreement for construction of the frontage
improvements , said improvements to be made by the applicant at the
same time as the improvements are constructed on the adjoining pro-
perty under Development Plan 3004-85.

CONDITIONS OF APPROVAL FOR MINOR SUBDIVISION 75-84:
1. Development shall be as shown on the tentative map dated received October 16, 1984
by the Planning Department.
2. Since this property is zoned Commercial, and since any future development of Parcel
A will require approval of a Development Plan, a Park Dedication Fee is not required
for this minor subdivision.
3. If archaeologic materials are uncovered during grading, trenching or other on-site
excavation, earthwork within 30 meters of these materials shall be stopped until a
professional archaeologist who is certified by the Society for California Archaeology
(SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity
to evaluate the significance of the find and suggest appropriate mitigation measures,
if they are deemed necessary.
4. Construction of pavement widening and sidewalks shall be done so that the two large
eucalyputus trees are undisturbed as much as possible. A narrowed sidewalk and/or
road shall be developed subject to Zoning Administrator review and approval. A
certified nurseryman shall review the proposed street improvement and submit a
report on their effect on the subject trees and mitigation measures that can be.taken
to lessen adverse impacts.
The above shall be accomplished prior to recording the parcel map. The details of
the proposed frontage improvements and nurseryman's report shall be submitted at
least 30 days prior to anticipated recording of the parcel map.
5. Comply with the requirements of the Public Works Department as follows except as
modified by condition #4 above.
A. In accordance with Section 92-2.006 of the County Ordinance Code, this
subdivision shall conform to the provisions of the County Subdivision
Ordinance (Title 9) . Any exceptions therefrom must be specifically
listed in this conditional approval statement.
B. Submit improvement plans to the Public Works Department, Land Development
Division, for review; pay the Anspection fee, plan review fee and
applicable lighting fees.
C. Construct .a 20-foot paved road to private road standards from Pacheco
Boulevard to the north property line of Parcel A.
D. Prevent storm drainage, originating on the property and conveyed
in a concentrated manner, from draining across the sidewalk or on
driveways.
E. Dedicate a drainage easement and observe the structure setbacks pursuant
to the requirements of the Ordinance Code for any drainage facilities
which convey .water from a puhlic street.

F. Furnish proof to the Public Works Department, Land Development Division,
of the acquisition of- all necessary rights of entry, permits and/or
easements for the construction of off-site, temporary or permanent,
road and drainage improvements. '
G. The followinq exception to Title 9 is permitted for this subdivision:
1. Chapter 96-10, "Underground Utilities," for the existing buildings
on Parcel B.
