CHIESA, CLERK-ADMINISTRATOR Costa DATE: April 19 , 1985 County SUBJECT: Parking Citation Contracts SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I. RECOMMENDED ACTION: Approve and authorize the chair to execute on behalf of the County contracts with the cities of Pleasant Hill ,. Danviile, San Ramon, Concord, Moraga, Clayton and Lafayette and the Bay Area Rapid Transit District for the purpose of. adjusting divi- sion of fines and forfeitures for parking citations to allow the county to recover operational costs . II. FINANCIAL IMPACT: These contracts represent one of two elements in a parking citation funding plan for the Walnut Creek-Danville , Mt. Diablo and Delta Municipal Courts . The second element is a concurrent increase in delinquency bails on parking citations approved by the judges of those courts . The contracts with the cities and districts provide that the courts may spinoff from gross parking .revenue receipts , the sum of 500 for each parking cita- tion which advances to a delinquent stage and deposit such monies in the county general fund for reimbursement of operating costs. The county will also receive its proportionate share of the new revenue generated by the bail increases on delinquent citations . The combined new revenue to the county from these two sources is estimated at approximately $26 ,500 annually from the three judicial districts . Despite the 500 spinoff to the county, the cities and districts will also realize additional income as the delinquency bail increases will generate revenues significantly greater than the amount required to fund the 500 spinoff. The new revenue to the county which will ,be generated by the parking citation funding plan was not anticipated in the adopted 84-85 FY budget. These contracts continue indefinitely except for the - city of Concord which terminates in three years . III. The county share of revenue generated from bails and fines on parking citations is prescribed by Section 1463 of the Penal Code. Those percentages are fairly low and in many instances are insufficient to cover the court ' s operating costs . The Chiefs of Police , Presiding Judges and Clerk-Administrators in those three judicial districts have , in concert , developed a fund- ing plan which will allow the county to recover its operating costs on parking citations . The agreements stem from an expressed desire on the part of the Chiefs of Police and the Presiding Judges to retain parking citation processing in the courts . To assist the county with data processing conversion costs and with on-going operating costs an equitable plan which recognized the differences in 1463 PC revenue splits in this county was needed. As a result , several cities and districts were exempted from the cost spinoff, one city was designated for a three year partici- pation and finally those cities and districts from which the county derives less than 16% of the parking citation revenues would authorize the cost spinoff on a permanent basis . IV. CONSEQUENCES OF NEGATIVE ACTION: The failure to execute these contracts would result in the county not receiving the new revenues which would be generated by the parking citation funding plan agreed upon by the courts , cities and districts .
