Costa DATE: May 7 1985 County SUBJECT: • Legislation: AB 1164 (Margolin) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position of support for AB 1164 by Assemblyman Margolin which would require the California Medical Assistance Commission -to consider the special needs of hospitals serving a disproportionate number of Medi-Cal beneficiaries when negotiating inpatient contracts, and appropriates $25 million for the purpose of implementing the bill. BACKGROUND: Existing law authorizes the Medical Assistance Commission to negotiate contracts for inpatient hospital services under the Medi-Cal program. In negotiating these contracts, the Commission is required to take into account a number of specific factors. AB 1164 would add to these factors the special circumstances of hospitals serving a• disproportionate number of Medi-Cal beneficiaries and other patients who are not covered by other third-party payors. AB 1164 would appropriate $25 million in order to reimburse hospitals serving a disproportionate number of Medi-Cal beneficiaries for their costs in providing such services. Presumably, this would be done by negotiating a more favorable per diem rate for such hospitals. AB 1164 is currently pending in the Assembly Ways and Means Committee. Because of the substantial benefit that passage of this bill could have on the hospital ' s Medi-Cal reimbursement rate, it is important that the Board support AB 1164 as is recommended by the Health Services Director.
