Adopted this Order on April 9, 1985 , by the following vote:

SUBJECT: Appeal of the Alhambra Valley Improvement Association,
Subdivision 6443, Alhambra Valley area (Deadhorse Ranch)
The Board on March 26, 1985 continued its hearing ..on the..'-
appeal
he..'appeal of the Alhambra Valley Improvement Association from the
County Planning Commissions decision approving the tentative map of
Subdivision 6443, D. B. Flett & Associates , Inc . (applicant) and
Deadhorse Ranch Investment Group (owner) to divide 121 acres in
General Agricultural District (A-2) into 17 lots , said property
being located approximately 1 ,000 feet north of Alhambra Valley Road
with access from a private road located between 5302 and 5324
Alhambra Valley Road , approximately 3,250 feet west of Reliez Valley
Road, in the Alhambra Valley/Martinez area.
Harvey Bragdon, Assistant Director of Planning, reviewed
the matter , and advised that the Planning Commission found that the
Initial Study of Enviromental Significance prepared for this project
identified potentially significant effects .on the environment , but
revisions in the project plans agreed to by the applicant would
avoid the effects or mitigate them to a point where clearly no
significant effects would occur; and that a Negative Declaration of
Environmental Significance was prepared and posted on July 20, 19849
which included said revisions in the project plans as mitigation
measures; and a Notice of Preparation of a Negative Declaration was
circulated to the property owners within 300 feet of the project and
to interested persons , agencies , and organizations , with a request
for comments by August 21 , 1984, and that the Commission had
reviewed the Negative Declaration together with any comments
received during the public review process .
Mr. Bragdon advised that the owner and applicant had
agreed to comply with the same infrastructure fees of $17,000 per
lot including $1 ,000 per lot for preparation of a Specific Plan as
imposed on other recent projects in the Alhambra Valley. Mr.
Bragdon advised that the City of Martinez had submitted a letter
this day advising that it supports the projects with the mitigations
that have been included as conditions of approval , and that it would
like the opportunity to review the improvement plans for the pro-
ject.
The Chair declared the hearing open and the following
persons appeared:
Frank Hackett, 100 Deodara Way, Martinez, who advised that
he would rather have had an EIR on the project , but if the same
results can be achieved and the character of the Valley can be pre-
served with a Specific Plan, he would not object , but he would like
to participate in the Specific Plan.
The Chair then read a letter from Dr. and Mrs . James Lynch
expressing concern regarding impacts relating to a 14.25 acre parcel
with respect to any increase in run-off to the creek, and to any
increase in traffic or noise .
Gordon Strain, 5020 Alhambra Valley Road, Martinez , who
discussed infrastructure fees and suggested that exceptions be

made for landowners in the Valley who wish to divide off a small
parcel for family members .
Mr . Bragdon responded that it would be staff's recom-
mendation that , in eases where lots are - being subdivided for agri-
cultural purposes and not to the ultimate density shown in the
General Plan, that there be an exception to the infrastructure
fee .
Hal Olson, representing the Alhambra Valley Improvement
Association, stated that the revised conditions , which had been
agreed to by the applicant and owner, would be acceptable to the
Association. ._
Doug Flett , of DBF & A Civil Engineers , Engineer for
Deadhorse Ranch project , expressed gratitutde to Supervisor
Fanden, the County staff and the citizens in the area, -.for
working out the conditions that are acceptable to all parties ,
and asked that the project be approved.
As recommended by Supervisor Fanden, IT IS BY THE BOARD
ORDERED that the appeal of the Alhambra Valley Improvement
Association is DENIED, and the Director of Planning is directed
to prepare for the Board' s consideration an order approving
Subdivision 6443 and incorporating the findings and conditions
agreed upon by all parties .
