HomeMy WebLinkAboutMINUTES - 04091985 - T.10 T 10 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 9 , 1985 , by the following vote: AYES: Supervisors Schroder , Torlakson and Fanden NOES: Supervisor McPeak ABSENT: Supervisor Powers ABSTAIN: None SUBJECT: Appeal of the Alhambra Valley Improvement Association from Planning Commission approval of MS 68-84 , Albert R . Compaglia , applicant , and Micahel D . Bell , owner . This being the time for hearing on the appeal of the Alhambra Valley Improvement Association from the Planning Commission approval of an application for MS 68-84 , filed by Albert R . Compaglia (applicant ) and Michael D . Bell (owner ) to divide 14 . 3 acres into 3 parcels with variance to have 2 parcels less than 5 acres in an A-2 zoning district , approximately 600 feet north of Alhambra Valley Road on a private road easterly and opposite Corte de la Canada , in the Alhambra Valley area; and Harvey Bragdon , Assistant Director of Planning , reviewed the project , including the size of the existing lots in the area . The Chairwoman declared the hearing open and the folowing persons appeared: A . R . Compaglia , 921 Ulfinian Way, Martinez , appli- cant , who indicated ageement to 3 lots being built on the property , with further development rights being dedicated to the County of Contra Costa , and advised that it was his opinion that the 3 homes would not change the character of the area , nor cause concern about flooding , and that the project is substantially in compliance with the General Plan and compatible with adjacent developemt , and that it meets the requirements of the Ordinance Code . Michael Bell , 5290 Alhambra Valley Road , Martinez , owner , commented that he had just recently learned of the infrastructure fees and suggested that since the land had previously been approved for one dwelling , the fee should be imposed on only two dwellings , and advised that he would favor the alternative lot size configuration which would provide for 3 more equally sized lots and for access to Parcels B & C from neighboring Subdivision 6443 (Deadhorse) . Marie Olson , 22 Wanda Way , Martinez , speaking for Ruth Newman , a member of the Board of Directors of the Alhambra Valley Improvement Association , discussed testimony presented at the two Zoning Administrator' s hearings , and the Board of Appeals hearing with respect to a 2-lot verus a 3-lot subdivision . Hal Olson , 22 Wanda Way, Martinez , for the Alhambra Valley Improvement Association , reviewed the history of 2 lots ver- sus 3 lots and the Zoning Administrator' s reconsideration , and com- mented that in his opinion , the 3-lot subdivision violates the policy on ranchettes and zoning as set forth in the General Plan . Mr . Olson advised that there is an urgent need to move forward with the specific plan . He advised he is not opposing the development , but rather the lot size and urged approval of only 2 lots . Frank Hackett , 100 Deodara Way , Martrinez , referred to letters from the City of Martinez and from California Equity Fund 1 representing Stonehurst , urging that the County go forward with a Specific Plan . Frank Boyle , Contra Costa County Fire Protection District , spoke to the need for adequate road width to accommodate emergency vehicles . Doug Flett , Engineer for Deadhorse Ranch , advised that Deadhorse Ranch does not want the access road for MS 68-84 on the Deadhorse subdivision . Mr . Compaglia appeared in rebuttal and suggested that the matter be continued to give the applicant an opportunity to review the total cost of complying with the new conditions and infrastruc- ture costs . The Chairwoman declared the hearing closed . The Board discussed with Mr . Bragdon the circumstances under which the recon- sideration of the first Zoning Administrator' s hearing was granted . Supervisor Fanden commented that she was satisfied with the explanation , and then commented on the various conditions she recommended for approval of the subdivision application , and recom- mened that the recorded map indicate that in approving this minor subdivision , it is not the intent of the Board of Supervisors that the lot size for this subdivision be precedent setting in any way . Supervisor Fanden also suggested that the applicant agree to make a $150 contribution to the Alhambra Valley Improvement Association , which is the amount of the appeal fee paid by that organization . The applicant agreed to make such a contribution . Supervisor McPeak indicated that she was concered with the question of fairness with respect to the imposition of $1 ,000 towards the cost of the Specific Plan and $17,000 per lot for infrastructure for a 3-lot subdivision . As recommended by Supervisor Fanden , IT IS BY THE BOARD ORDERED that the appeal of the Alhambra Valley Impovement Association is DENIED and the application for MS 68-84 is APPROVED , subject to the conditions set forth in Exhibit A , attached hereto and by reference incorporated herein , and the Board adopts the fin- dings of the Planning Commission . adopted February 12, 1985 . Applicant Contra Costa Fire Protection Dist . 2 EXHIBIT A CONDITIONS OF APPROVAL FOR MINOR SUBDIVISION 68-84 (Revised) 1. This approval is based upon the tentative map submitted with the application dated received by the Planning Department September 7, 1984. 2. An exception is granted for Parcels A and B to contain less than five (5) acres as shown on the tentative map. 3. The existing scenic easement on the property shall be modified to encompass not less than five (5) acres on Parcel C, subject to review and approval by the Zoning Administrator prior to recording the parcel map. Development rights for other than one single family residence on Parcel C shall be granted to the County. 4. Prior to recording of a parcel map, a geology and soils report shall be sub- mitted for review by the Planning Department (County Geologist) . Information available shows the private access road crossing a landslide deposit. The ei - tent and depth of the deposit and provision for its stabilization shall be determined prior to recording the map. Bonding for grading and construction of the access road may be required. 5. If archaeologic materials are uncovered during grading, trenching or other on- site excavation, earthwork within 30 meters of these materials shall be stopped until an archaeologist certified by the Society for California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the find and suggest appropriate mitigation measures, if they are deemed necessary. 6. This minor subdivision is conditionally approved, subject to the applicant ob- taining the necessary approval from the County Health Department for the utiliz- ation of individual sewage disposal on each parcel and provision for water supply and service. 7. A building sideyard distance not less than 40-ft., shall be provided along the south boundary of Parcel C. 8. Comply with the requirements of the Public Works Department: A. In accordance with Section 9?-?.006 of the County. Or J i,►ance Code, this subdivision shall conform to the provisions of the County Subdivision Ordinance (Title 9) . Any exceotions therefrom must be specifically listed in this conditional approval statement. 1. Construct a ?Q-foot paved road to orivate road standards form south property line of Parcel A to the south property line of Parcel C to the subject property. The existing bridge over Del Hambre Creek shall he widened or replaced to provide an unobstructed 10-foot travelled way,, suhject to Fire District approval . Turnouts shall be provided at 500-foot intervals. C. Furnish proof to the Public Works Department, Land neveiopment Division, of the acquisition of all necessary rights of MS 68-84 Page 2 entry, permits and/or easements for the construction of offsite, temporary or permanent, road and drainage improve- ments. 0. Furnish proof to the Public Works Department, Land Development Division, that legal access to the property is available from Alhambra Valley Road. E. Contribute $0.25 per square foot of impervious surface area to the County Drainage Deficiency Trust Fund designated for Zone 5 for the construction of area-wide drainage improvements. F. The creek crossing shall be widened to 20-feet and shall utilize a culvert.. A drop structure shall he incorporated into the design. Full credit against the drainaqe fee shall he allowed for the drop structure. a G. Convey to the County, by Offer of Dedication, a drainaqe easement of sufficient size to encompass the drop structures and access required for their maintenance. H. Improvements plans ,for storm drainage and traffic related items shall be subject to review by the City of Martinez. I. Contribute $1,000 per lot to the County within 90 days of the Board of Supervisors' action on the appeal to provide partial financing of a Specific Plan for Alhambra Valley. J. Storm water from Parcel A shall be conveyed in a closed conduit and discharged into the drop structure. K. Underground all utilities. L. Contribute $17,000 per lot as the developments fair share of the area's infrastructure needs. Full credit towards this contribution will be allowed for the following;. ; 1 . Fire Facilities Contributions 2. Park Dedication Fee (City and County) 3. Road Improvements/Contributions (City and County) 4. Drainage Mitigation Contribution/Improvements 5. Specific Plan Contribution T Domestic Water Supply (pump .'stations, reservoirs, and mains to reservoirs). M. Contribute $150 to the Alhambra Valley Association. MS 68-84 Page 3 N. The map shall contain a statement that no prece� ent is intended in the approval of the substandard lots sizes. The following statements are not conditions of approval. Box 951 Martinez, CA 94553 Attn: Byron Turner SUBJECT: MS 68-84 5290 Alhambra Valley Road Martinez Dear Mr. Turner: We have reviewed the application for a minor subdivision at the subject location. This project is regulated by codes and ordinances administered by this Fire District relative to Contra Costa County Ordinance 83/44. If approved by your office, the following shall be included as conditions of approval: 1. The developer shall provide an adequate and reliable water supply for fire protection with a minimum fire flow of 1,250 GPM. Required flow shall be delivered from not more than two 12) hydrants flowing simultaneously while maintaining 20 pounds residual pressure in the main. (10.301c)UFC 2. The developer shall provide two (2) hydrants of the East Bay type. Location of hydrants will be determined by this office upon submittal of 3 copies of a tentative map or site plan. Cost of the installation to be borne by the developer. (10.301c)UFC Note: According to available information, existing water supply facilities in the area are not adequate to provide the required fire flow. You are advised to contact the appropriate water district to determine whether the required flows can be made available before proceeding further with the project. 3. All portions of the access roadway shall have an all-weather driving surface of not less than 20 feet of unobstructed width, and not less than 13'6" of vertical clearance, to within 150 feet of all portions of the exterior walls of every building. Access roads shall not exceed 20% grade, shall have a minimum inside turning radius of 28 feet, and must be capable of supporting the imposed loads of fire apparatus (16 tons) . Dead-end fire department access roads in excess of 150 feet long shall be provided with approved provisions for the turning around of fire department apparatus. (10.207a)UFC 5. Where open space is to be maintained for public or private use, access into these areas from public ways shall be provided. These access ways shall be a minimum 16 foot width to accommodate fire department equipment. The continued access and maintenance of the District's fire trail system shall also be insured. All open spaces, when left in their natural state, shall meet the Fire District's weed abatement standards. Where practical, we .would encourage the use of the U.S. Department of Agriculture's Land Management Program utilizing livestock grazing. This would require fencing the properties and allowing animals to graze to approximately a 25% residual. If this method is not utilized, mechanical abatement shall be required. Contact Senior Inspector Emery of this office for minimum weed abatement requirements. (87.104)C.C.C. Ord. 83/44 6. Due to the extended emergency response time, approximately 6 minutes, to the subject location, building shall be protected by. an approved automatic fire sprinkler system and have fire-retardant roof covering.
