SUBJECT: Domiciling of Horses
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) a: BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. Take no action on the request that existing standards be
changed. which would allow horses on less than a 40,000
square foot lot (one acre) .
2. Indicate the Board's willingness to consider a pilot project
whereby standards might be included for selected new
developments providing for a horse on less than a 40 ,000
square foot lot with approval of the Planning and Health
Services Departments.
3. Refer the matter to the Director of Planning and the Health
Services Director to develop appropriate language for an
ordinance which would: A) establish such a pilot project in
an appropriate future new development; B) provide authority
to maintain a horse on a lot which is less than 40,000
square feet; C) include appropriate safeguards to reduce to
a minimum the likelihood of public health problems and
nuisance problems, including but not limited to, the
presence of flys, dust, odor, noise, and the possibility of
water supply contamination, and return such a proposal to
the Board when an appropriate new development is identified.
4. Remove this item as a referral to our Committee.
BACKGROUND;
The issue of domiciling horses on lots with less than 40,000
square feet has been on referral to our Committee for over two
years. Most recently, on November 8 , 1983 , the Board, in
adopting the report of its 1983 Internal Operations Committee,
indicated it was not impressed with the possibility of
successfully reducing the domiciling standards on existing
residential developments where the neighbors bought homes with
the understanding there would be no horses in the development
because the lots were all less than one acre. The Board, at that
time, indicated a willingness to consider less than one acre
standards on new developments, and indicated a willingness to
review any proposal submitted by the California State Horsemen' s
Association.

Our Committee met with George Cardinet, Dale Brooks, Gary Siegel,
the Director of Planning, and Dan Bergman of the Health Services
Department on March 25, 1985 to review Mr. Cardinet' s February
24, 1985 proposal. After reviewing Mr. Cardinet's proposal, our
Committee remains convinced that the rules should not be changed
on existing developments. We are, however, willing to suggest
that the Board be willing to consider a pilot proposal in a
selected, appropriate new development where everyone moving into
the area is aware that horses might be kept on, say, a 20,000
square foot lot if appropriate containment and drainage are
provided for.
