NOES: None . ABSENT: None . ABSTAIN: None. SUBJECT: Determination of Property ) Tax Exchange for Stations ) RESOLUTION NO. 85/174 Annexation to the City of ) Walnut Creek (LAFC 84-38 ) ) WHEREAS, Section 99 of the Revenue and Taxation Code provides that the City and the County shall agree by resolution to exchange property tax revenues among themselves and any affected agencies ; and WHEREAS, the Stations Annexation to the City of Walnut Creek (LAFC 84-38) involving annexation of territory to the City of Walnut Creek is excluded from the application of the master agreement between the City and the County because of the amount of the assessed value of the territory involved in the annexation; and WHEREAS, the City of Walnut Creek and the County have agreed that the terms of the master agreement shall apply to the subject annexation except that the amount of the base property tax to be transferred to the City from the County shall be half of the amount calculated by the formula in the master agreement. All other terms of the master agreement shall apply, including the treatment of County Service Areas; NOW, THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that in accordance with Section 99 of the Revenue and Taxation Code, the property tax transfer for the affected agencies in the area of the Stations Annexation to the City of Walnut Creek (LAFC 84-38) shall be in accordance with the master property tax agreement as modified in the preceding paragraph. Said property tax transfer agreement applies to affected territory as submitted or revised by the Local Agency Formation Commission. This resolution does not change the property tax revenues accruing to other agencies serving the subject territory or the affected districts' right to collect taxes for existing bonded indebtedness. 1 hereby certify.that this Is a true and correct copy of an action taken and entered on the minutes of the Board of Supervlpqrs on tre date shown. SUBJECT: Determination of Property ) Tax Transfer for the Marsten/ ) RESOLUTION NO. 85/ 177 Hercules Boundary Reorganization) LAFC 85-7 ) ) WHEREAS, the Revenue and Taxation Code provides that the City and the County shall agree to exchange property tax revenues between themselves to reflect transfer of service responsibilities resulting from annexation of territory to the City; and the Revenue and Taxation Code further provides that when responsibility for providing a service is transferred from one special district to another, the Board of Supervisors shall determine the amount of property tax revenues to be exchanged between the districts; and WHEREAS, the Marsten/Hercules Boundary Reorganization (LAFC 85-7 ) involves annexation of territory to the City of Hercules for which proper- ty tax exchange is determined by the previously approved master property tax exchange agreement; and WHEREAS, the reorganization proposes concurrent annexation to the Rodeo Fire Protection District, detachment from the Pinole Fire Protection District and withdrawal from County Service Areas LIB 10 and P-6 ; and WHEREAS, County Service Areas LIB 10 and P-6 do not receive property tax revenue from the affected territory of the boundary reorganization; NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY DOES HEREBY DETERMINE that 100 percent of the property tax accruing to the Pinole Fire Protection District from the affected territory of the Marsten/Hercules Boundary Reorganization (LAFC 85-7) shall be transferred to the Rodeo Fire Protection District and that there be no transfer of property tax from County Service Areas LIB 10 or P�6 as a result of the boundary reorganization. The terms of this property tax exchange agreement shall be effective for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change and shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. This resolution does not change the property tax revenues accruing to other agencies servicing the subject territory or the affected agencies right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commis- sion. This resolution is supplemental to the existing master property tax exchange agreement between the City of Hercules and the County of Contra Costa which is also operative with respect to the subject jurisdictional change. 1 hereby certify that this Is a true and correct copy of. SUBJECT: Determination of Property ) Tax Transfer for Annexations ) 263 , 264 and 265 to West ) RESOLUTION NO. 85/173 Contra Costa Sanitary District) (LAFC 85-5, 85-4 and 85-6 ) Respectively) ) WHEREAS, Section 99. 1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a Special District providing one or more services to an area where such services have not been previously provided shall not become effective if one or more special districts involved in the property tax exchange negotiation fails to adopt a resolu- tion agreeing to a transfer; and WHEREAS, the Board of Supervisors shall determine the property tax exchange for each affected district, except for the annexing district, that fails to adopt a resolution agreeing to a property tax transfer; and WHEREAS, Annexations 263 , 264 and 265 to West Contra Costa Sanitary District (WCCSD) (LAFC 85-5 , 85-4 and 85-6 respectively) propose annexa- tion of territory which results in the provision of services not previ- ously provided and no resolutions have been adopted agreeing to property tax exchanges; and WHEREAS, in the absence of a master agreement for property tax exchange between the County and WCCSD, the County and WCCSD agreed that the property tax exchange agreement for these annexations will be in accordance with the terms of the existing master agreement between the County and the Central Contra Costa Sanitary District and the 'East Bay Municipal Utility District. THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that the property tax increment allocation factors for the affected agencies in the area of annexations 263 , 264 and 265 to West Contra Costa Sanitary District (LAFC 85-5, 85-4 and 85-6 respectively) shall be in accordance with the above master agreement for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change and that the Auditor-Controller is directed to apply the terms of the master agreement between the County and the Central Contra Costa Sanitary District and the East Bay Municipal Utility District to the subject annexations. The factors shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. Said increment tax alloca- tion factors apply to affected territory as submitted or revised by the Local Agency Formation Commission.
