SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position of support for SB 1078 which will continue indefinitely 95% State
funding for foster care costs. -
REASON FOR RECOMMENDATION:
Current law provides for State funding at a level of 95% of the non-federal share of
the cost of providing care for AFDC children in foster homes and institutions. That
law sunsets effective December 31 , 1985. State funding would then revert to a complex
formula of percentages and caps on monthly shares which would have the effect of
increasing the County cost of caring for some individual children by 1000% or more.
Overall , we estimate that County costs could increase by nearly $2 million in 1985-86
if this legislation is not enacted.
BACKGROUND:
Prior to 1978, counties bore a substantial share of the non-federal cost of foster care
and institutional payments. Following a one-year bailout in 1978-79, the 95% State
share of the non-federal costs of foster care was implemented on July 1 , 1979. Since
that time, the State has increasingly taken over the authority and responsibility for
fixing foster home payment rates and for approving rates for institutions. Counties,
therefore, have little control over the rates that are paid. Therefore, continuing
payment by the State at levels consistent with those paid over the past six years
seems appropriate.
At the request of the County Supervisors Association of California and the County
Welfare Directors Association, AB 454 was introduced by Assemblymember Frank Vicencia
on this subject and a position of support for that bill was adopted by the Board on
February 12, 1985. SB 1078 introduced by Senators Bill Greene, Presley, and Seymour,
and co-authored by Assemblymember Vicencia, has identical language and deserves the
active support of the Board of Supervisors.
