That the Board of Supervisors of Contra Costa County as and constituting the Board of Directors 'of Contra Costa County Sanitation District No. 19, introduce Ordinance No. 5 entitled "An Ordinance establishing annual sewer and water service charges for Fiscal Year 1985-86 in Contra Costa County Sanitation District No. 19." 2. That the Board of Supervisors hold a public meeting to consider oral and written objections or comments concerning establishing the annual sewer and water service charges for Fiscal Year 1985-86, on May 21, 1985 at 10:30 a.m. in the Board of Super- visors Chambers, 651 'Pine Street, Martinez, California. 3. That a notice of the time and place of the meeting including a general explanation of the matter to be considered be mailed at least 14 days prior to the meeting to any interested party who files a written request with the District for mailed notice pursuant to Government Code Section 54992. 4. That at least 10 days before the public meeting, the District shall make available to the public data indicating the amount of cost, or estimated cost, required to provide the service for which the charge is levied, and the revenue sources anticipated to provide the service. FINANCIAL IMPACT The above actions have no impact on County finances. County services to Sanitation District No. 19 are funded entirely by the annual water and sewer service charges. REASONS FOR RECOMMENDATION/BACKGROUND Each year the County Sanitation Districts are required to set by Ordinance the annual sewer and water service charges. Government Code Section 54992 describes what steps are necessary before such an ordinance can be adopted. PASSED on by the following vote: AYES: NOES: ABSENT: Board Chair ATTEST: PHIL BATCHELOR Clerk of the Board and County Administrator By: Deputy sdl5:ord10.8586 0 PROPOSED SEWER USE RATE SCHEDULE FOR CONTRA COSTA COUNTY SANITATION DISTRICT NO. 15 This Proposed Sewer Use Rate Schedule was prepared in response to a June 26, 1984 request from the Contra Costa County Board of Supervisors that the Public Works Department review the existing rate schedule applied to Sanitation District No. 15 users. The review was requested by the Board in response to complaints from the Bethel Island Marina Owners Association. . The focus of the review was to answer complaints that: (1) "A fixed (dollar) charge is levied against an indeterminate service", and (2) "Because it is (currently) impossible to quantify the service performed, it cannot be shown that the cost to the user is in accordance with the laws of the State of California which require -- inter alia and in effect -- that the charge exacted be proportional to the service rendered. " To answer the above complaints, the Public Works Department staff calculated the service rendered to Sanitation District No. 15 users based on wastewater flow and sanitary loading. Staff presented the original findings to the SD 15 Citizens Advisory Committee (CAC) on December 6, 1984. The Draft Proposed Sewer Use Rate Schedule was submitted to the CAC on January 10, 1985, for their approval . The CAC recommended that some changes be made to staff's proposal. On February 14, 1985, before the modified schedule was subject to further public review and comment, the Citizens Advisory Committee voted to hold a workshop on February 28, 1985 to discuss the modified schedule in detail . Additionally, in response to a request from the Bethel Island Marina Owners Association, staff researched the possibility of allowing metered water use to be used to determine the annual charge in lieu of the unit multipliers. Staff ' determined that a metered water use alternative could be implemented 'if the following conditions were applied: 1. A single lateral serves three or more multiplier units not including all permanent dwelling units. 2. Meters must meet American Water Works Association (AWWA) standards. 3. All sewage generating uses and areas must be metered. 4. Meters must be calibrated periodically and proof of calibration submitted upon order of the District Engineer. 5. To allow sufficient time to place metered uses on the tax rolls, the annual Water use year will run from January 1 through December 31 inclusive. 6. Meters must be installed and operating by July 1 of previous year to be eligible to have annual charges for subsequent fiscal year based on metered water flow. All following years require full year readings (i.e. , meter must be installed and operating by July 1, 1985 to use meter flow readings for 1986/87 annual sewer charges). Annual sewer use charges will be based on previous calendar year flows. 7. Meter readings will be converted to equivalent (single-family residential) units and multiplied by a factor of 1.05 (five percent increase) to account for additional staff time required. Presently, the equivalent single-family residential unit equals 36,500 gallons of effluent per year. However, this gallonage equivalent is subject to change as data warrants. 8. An additional factor will be applied to the users whose sanitary strength varies significantly from typical domestic sewage. The District Engineer will determine the sanitary •strength factor in accordance with industry data, and periodic wastewater testing where appropriate. 9. All meter installations shall be submitted to Sanitation District 15 staff for review, inspection, and approval before start of work. 10. Sanitation District 15 staff shall have reasonable access to all meters, as well as the system being metered. After much discussion between themselves, the general public, and staff, the CAC recommended that any alternative system. be tabled indefinitely. The CAC ' s reasons for tabling the alternative system include the following: 1. It is not equitable to charge one group of users on actual wastewater flows and another group on estimated wastewater flows. 2. All existing sanitary and sanitation districts that allow commercial users to be charged on actual wastewater flow have years of residential flow data available. This flow data provides a much better basis for determining what the commercial users should be charged in relation to the residential r users. If a district-wide public water system is ever installed in SD 15 then the rate schedule could and should be modified to use water flow records, since meters will be installed as part of the water distribution system and the readings can be used to determine both water and wastewater charges. 3. Although many Sanitation District 15 business people signed a petition requesting that the existing unit multiplier rate be amended to allow all non-residential users billed in excess of three (3) units an alternative billing rate based on metered water inflow, many of the petition signers stated at the March 14, 1985 CAC meeting that because the CAC had modified the proposed unit multiplier on the sewered trailers and removed the multi- plier for gas docks, the proposed rate schedule was equitable and hence the alternative metering system was not necessary. Even though the CAC approved tabling the metering alternative, the CAC stated that they are not stopping the commercial users from installing their own meters. In fact, the CAC encouraged the commercial users to install meters because that could provide additional data which could be helpful in the future for determining whether or not the proposed sewer use schedule is equitable. sdl5:proposed.rate.8586
