SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Adopt a position in support of SB 172 by Senator Maddy which
would make the current deduction for direct charitable
contributions under State law permanent.
BACKGROUND:
Under the State Personal Income Tax law, a deduction is allowed
for direct charitable deductions allowed under the Federal
Income Tax law, but under State law this deduction is available
only for charitable contributions made before January 1 , 1987.
SB 172 would make this deduction permanent thereby providing
substantial incentives for individuals to continue providing
charitable contributions to eligible private, nonprofit
organizations.
Inasmuch as SB 172 is an effort to continue insuring private
support for charitable organizations, many of which provide
services in support to those provided by local government, SB
172 deserves the Board' s support.
SB 172 passed the Senate March 28 by a vote of 25: 1 and is
currently on referral to the Assembly Committee on Revenue and
Taxation.
