HomeMy WebLinkAboutMINUTES - 04231985 - T.11 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 23 , 1985, by the following vote: AYES: Supervisors Powers , Schroder , McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None ------------------ SUBJECT : -------------SUBJECT: Revocation Hearing on Land Use Permit 2121-82, issued to Delta Associates , Bethel Island Area The Board on March 19,1985 fixed this time to " consider whether to revoke Land Use Permit 2121-82, issued to Delta Associates in the Bethel Island Area. The Director of Planning provided affidavits showing that Delta Associates received written notice of this revocation hearing and that Notices of this hearing had also been posted in accordance with the provisions of the County Ordinance Code. Harvey Bragdon, Assistant Director of Planning, advised that the purpose of this hearing is to consider whether cause exists to revoke LUP 2121-82 which was granted, with conditions , on April 1 , 1983 to Delta Associates for an expansion of existing recreational facilities by establishing a recreational vehicle park, dry boat storage, campground , and boat and trailer area. Mr . Bragdon advised that staff has found violations of the conditions of the permit continuing even after notice of the violations , and recommends that all uses authorized by this permit be revoked and those uses be terminated within 30 days of this hearing . A report from staff , dated April 23 , 1985 , has been filed with the Board, more particularly setting forth staff' s recommendation and the reasons and evidence supporting the recom- mendation. The Chairwoman declared the hearing open and invited those interested to address the Board. Mr . Howard Holmes , representing the Bethel Island Municipal Improvement Association, appeared and submitted, without comment , written documents relating to the violations of the subject land use permit.. Mr. Don Adams was present in the audience, was advised by County Counsel that this was the time and place for him to submit written documents , to voice any objections to the proceedings and to raise any and all issues and matters to be considered with respect to the subject permit , but he indicated that he declined to speak, and did not submit any written statement . No one else indicated_a desire to speak, and the Chairwoman closed the public hearing. Supervisor T orlakson commented that the applicant had been given many opportunities to meet the conditions of the Land Use Permit , but that said conditions had not been met . He stated that he had concern for the residents of the park who may be affected, that it has cost the County many thousands of dollars to monitor said permit , that conditions had still not been met , and that therefore he would recommend support of staff' s recommendation that the permit be revoked. Based upon the testimony, reports and other documents sub- mitted, this Board hereby FINDS that with respect to the use of the property covered by Land Use Permit 2121-82 , there have been continued violations of the terms of the permit after notice of such violations , to wit: 1 . Development is not as shown on plans submitted by the applicant on November 23 , 1982, _. in that a restroom facility has not been built (Condition No. 1 , Permit No. 2121-82. ) ; 2. None of the requirements of the Public Works Department have been satisfied (Condition No. 9, A through 1 , Permit No. 2121-82. ) ; 3 . The requirements of County Sanitation District No. 15 have not been completely satisfied, in that the lift station is not operational (Condition No. 9, J. , Permit No. 2121-82 ; Board Order . dated February 5, 1985) ; and 4 . The Oakley School District Bedroom Fee has not been paid (Board Order dated February 5, 1985). IT IS BY THE BOARD ORDERED that , based separately upon each of the above violations (including each of the separate violations of Condition No' o. 9 of Permit No. 2121-82) , and pursuant to Contra Costa County Ordinance Code 526-2 . 2022 , Land Use Permit 2121--82 , issued to Delta Associates , is . hereby REVOKED.
