HomeMy WebLinkAboutMINUTES - 04231985 - 2.3 L THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Establish fees for ) Underground Storage of ) Resolution No. 85/202 Hazardous Substances - ) (H.&S.C. 525287 . ) Incorporated Areas of County ) The Contra Costa County Board of Supervisors resolves that : Pursuant to Health & Safety Code 525283, the County is required to implement the provisions of Chapter 6.7 (commencing with 525280 ) of the Health & Safety Code (hereafter , all section references are to the Health & Safety Code) in the incorporated areas of the cities in the County , except in cities which have elected to assume responsibility for implementing the provisions of said chapter . Section 25284 generally prohibits the owning or operating of an underground storage tank unless permit for its operation has been issued by a local agency ( the County) to the owner . Section 25287 (x-) requires the local agency with enforce- ment jurisdiction to establish fees at a level sufficient to pay the necessary and reasonable costs incurred in administering Chapter 6. 7 , to be collected from each person who submits an application for a permit to operate an underground storage tank or to renew or amend a permit . The fees herein imposed are at a level sufficient to pay the necessary and reasonable costs incurred in administering %ChRpter 6. 7 , including, but not limited to, permitting and inspection responsibilities . The fees imposed herein shall apply to all facilities located in the incorporated areas of this County, except in the incor- porated areas of those cities which , by ordinance, have assumed responsibility for implementing the provisions of. Chapter 6. 7. Pursuant to §25287 (a) , the followiAn ile�S� r ��5hereby established and imposed, effective P 1 _ _ __, except for the initial permit fees for facilities ins-talled on or before January 1 , 1984, which shall be effective upon the effective date of the regulations adopted by the State `Vater Resources Control Board pursuant to 525299. 3 , implementing the standards of §25292 : 1 . Initial Permit Fee --Facilities Installed After January_1i_1984 . For facilities for the underground storage of hazardous substances installed after January 1 , 1984, the fee for the permit required by C.C.C. Ord.C. 5413_-5.150 shall be as follows : a. For a single underground storage tank (hereafter "tank" ) installation of 12, 000 gallons or less , $320. 00 . The applicant may elect to pay the fee in installments , as follows: $200. 00 at the time of application, and $30 on each anniversary date of permit issuance for the next four years . b. For a single tank installation of more than 12 ,000 gallons , y up to 50;000 gallons , $420.00. The applicant may elect to pay the fee in installments , as follows; $320. 00 at the time of application, and $30. 00 on each anniversary date of permit issuance, for the next four years . C. For a multiple tank installation of up to 50, 000 gallons aggregate capacity, $300 . 00 , plus $120 . 00 for each tank. RESOLUTION NO.85/202 The applicant may elect to pay the fee in installments , as follows : $300 . 00 at the time of applieatf-on , and $30 . 00 per tank on each anniversary date of permit issuance for the next four years . d. For a single tank installation of more than 50 , 000 gallons , $520 . 00 . The applicant may elect to pay the fee in installments , as follows : $400. 00 at the time of application, and $30 . 00 .on . each anniversary date of permit issuance for the next four years . e. For multiple tank installations of more than 50 , 000 gallons aggregate capacity, $400.00 , ..pliis $120 .00 for each. tank. The applicant may elect to pay the fee in installments , as follows : $400 . 00 at the time of application, and $30 . 00 per tank on each anniversary date of permit issuance for the next four years . 2. Initial Permit Fee - Facilities Installed on or before ------------------------------------------------------ January_1Z-1984. For facilities for the underground storage of hazardous substances installed on or before January 1 , 1984 , the fee for the permit required by C.C.C. Ord. C. 5413-5 . 150 shall be as follows : a. For installations of four or fewer tanks , $200 . 00 plus $120. 00 per tank. The applicant may elect to pay the fee in installments , as follows : $200. 00 at the time of application , and $30 . 00 per tank on each anniversary date of permit issuance for the next four years . b. For installations of more than four tanks , $200 , 00 plus $150. 00 per tank. The applicant may elect to pay the fee in installments , as follows : $200. 00 plus $30.00 per tank at the time of application, and $30 .00 per tank on each anniversary date of permit issuance for the next four years. 3. Permit_'Renewal Fee. The fee for renewing a permit shall be $150. 00 per tank. The applicant may elect to pay the fee in installments , as follows : $30 . 00 per tank at the time of renewal application, and $30. 00 per tank on each anniversary date of permit renewal for the next four years . 4. Permit Amendment-Fee. The fee to amend a permit shall be $100 . 00 per tank. 5. Abandonment Fee. The fee to abandon a tank shall be $100.00 per-tank. -2- RESOLUTION NO. 85/202 STATESURCHARGE. Pursuant to Health and Safety Code §925287 and 25299_1 , a surcharge shall be collected from the applicant for a permit required by C.C.C. Ord.C. §413-5:150 , or the renewal thereof . This additional surcharge shall be in the n.mount established by the Legislature at the time of application, and shall be collected at the time of permit application. S§25280ff. ) County The The Contra Costa County Board of Supervisors resolves that : On December 13 , 1983_, the Board of Supervisors passed Ordinance No. 83-68 , adding Chapter 413-5 , on underground storage of hazardous substances , to the Contra Costa County Ordinance Code.
