HomeMy WebLinkAboutMINUTES - 04161985 - T.4 l� T.4 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 16, 1985 , by the following vote: AYES: Supervisors Powers , Schroder , McPeak, Torlakson and Fanden NOES: None ABSENT: None ABSTAIN: None SUBJECT: Appeal of G. C. Soe, Eurasian Home Company, from Planning Commission approval , with conditions , of Subdivision 6514, E1 Sobrante area. This is the time for hearing the appeal of G. C . Soe, Eurasian Home Company, from the approval , with conditions , by the County Planning Commission of the application for Development Plan 3051 and a tentative map for Subdivision 6514, Edward Biggs , owner and applicant , to convert a 51-unit condominum with recreational area. Mr . Harvey Bragdon, Assistant Director of Planning, described the application as 7.36 acres located at the southeast corner of San Pablo Damn Road and Greenridge Drive in the E1 E1 Sobrante area , and advised that a Negative Declaration of Environmental Significance was posted for Development Plan 3051 and Subdivision 6514. Mr. Bragdon advised that the Planning Commission approved the development plan and the tentative map for Subdivision 6514, with conditions , but declined to impose a condition that would require a sewer easement across the property as requested by the appellant . The Chairwoman declared the hearing open and the following persons appeared and gave testimony with respect to the above appeal: Mr . David Fisher , owner of adjacent property, explained the difficulty of the terrain and the potential for slides on his pro- perty and on appellant's property if the ground is disturbed for installing sewer lines , and requested that the Board condition approval of Subdivision 6514 to require a dedicated public sewer easement across its open space area to accommodate future develop- ment of his , as well as the appellant' s property. Supervisor Powers commented that it appeared that only two or three lots would be served and suggested that the property owners look into working with the West County Sanitary District or arrange to purchase an easement from the owner. Stewart Saffine , Attorney for appellant , advised that from a topographic and engineering standpoint it is highly undesirable to run a sewer line across. his client's property as opposed to running it across the open space of Subdivision 6514, and thereupon requested that an area in the open space be reserved for such an easement through an offer of dedication for public purposes . -1- 0 -J. Edward Biggs , representing E1 Grande Town Homes , owner of one half of the property, and Biggs Realty Inc , owner of the other half of the property, commented that his soils engineer had advised that it would be too risky to disturb -the foot of the hill in the area where the appellant is seeking an easement for a sewer line because of the danger of the soil sliding. Board members discussed the matter. IT IS BY THE BOARD ORDERED that the appeal is DENIED.
