SUBJECT: . Referral by Planning Commission of Collect and Convey
Drainage Requirements for MS 78-84, Oakley area.
This is the time for hearing on the referral by the
Contra Costa County Planning Commission, sitting as the Board of
Appeals , of the collect and convey drainage requirements for
MS 78-84 (Charles Pringle , applicant and owner) in the Oakley area.
Mr . Harvey Bragdon, Assistant Director of Planning,
advised that the property is described as being Parcel B of
MS 140-77, fronting 576 feet on the south side of Brownstone Road,
approximately 400 feet west of State Highway 4 in the Oakley area,
and that a Negative Declaration of Environmental Significance was
posted for this application on January 18, 1985 .
Mr . Bragdon advised that the Zoning Administrator had
approved the application for MS 78-84 with conditions , that the
applicant had appealed one of the conditions from that decision to
the Board of Appeals , and the Board of Appeals denied the appeal and
referred the matter of the drainage requirement condition directly
to the Board of Supervisors , and indicated that it was the intent of
the Appeals Board to allow two lots only as it felt that two lots
represented the maximum number of lots that should be approved at
this time because, for four lots , the requirements of Ordinance Code
Section 26-2.2006 and the general plan cannot be met .
The Chairwoman declared the hearing open.
Mr. Charles Pringle, P . 0. Box 658, Brentwood , appeared
and explained his position and urged the Board to remove the collect
and convey drainage requirement condition and agrued that a 4-lot
subdivision could be approved , should city water be available prior
to the recording of the subdivision map.
No one else appeared to speak. The Chairwoman declared
the hearing closed.
The Board discussed the testimony presented and discussed
with staff the reasons for the recommended condition of approval .
As recommended by Supervisor Torlakson, IT IS BY THE BOARD
ORDERED THAT the Board AFFIRMS the decision of the County Planning
Commission, sitting as the Board of Appeals , and DENIES the request
for exception from the collect and convey drainage requirements for
MS 78-84 because , among other reasons , the requirements of Ordinance
Code Section 92-6 .002 cannot be met .

CONDITIONS FOR APPROVAL OF MINOR SUBDIVISION 78-84:
1. This request is approved for two parcels with a minimum parcel size of 100,000 sq. ft.
2. The applicant shall submit an application for rezoning the property to Single Family
Residential R-100.
3. Prior to preparation of the Parcel Map, submit a revised tentative map for two
parcels which meet the requirements of the R-100 zoning district. Indicate on the
map the location of existing well and sewage disposal system.
4. This minor subdivision is conditionally approved, subject to the applicant obtaining
the necessary approval from the County Health Department for the utilization of
individual sewage disposal on each parcel.
5. The applicant shall comply with the Health Department requirments for water supply.
6. Prior to recording the Final Map or issuance of any grading or building permit on
parcels created by this subdivision, applicant shall submit a soil and foundation report
to the Planning Department for review and approval. The report should evaluate and
mitigate any potential damage from earthquake-induced liquefaction. Allow 45 days
for review and approval. Building Department permit plans shall implement approved
recommendations of the soil and foundation report.
7. The zoning variance is approved as requested; it meets the requirements of Section
26-2.2006 of the County Ordinance Code.
S. If archaeologic materials are uncovered during grading, trenching or other on-site
excavation, earthwork within 30 meters of these materials shall be stopped until a
professional archaeologist who is certified by the Society for California Archaeology
(SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity
to evaluate the significance of the find and suggest appropriate mitigation measures,
if they are deemed necessary.
9. Comply with the requirements of the Public Works Department letter of February 12,
1985.
10. Comply with the Oakley Area Fire District Ordinance requirements and pay $300.00
fee per each new building or dwelling prior to issuance of building permit.
The following statements are not conditions of approval. However, you should be aware
of them prior to requesting building permits on the parcels of this minor subdivision.
A. The Building Inspection Department advises as follows:
A grading permit may be required for the earthwork necessary to develop all parcels
in the above minor subdivision.
Submit four (4) copies of plans showing the existing contours, the extent of the
` proposed grading, drainage improvements and general site development.
The plans accompanying the application for building permits shall show the existing
contours, the extent of the proposed grading and drainage improvements, and be
reviewed by the Grading Section prior to issuance.
