Adopted this Order on March 5 , 1985 , by the following vote:
AYES: Supervisors Powers , Schroder , McPeak , Torlakson, Fanden
NOES: None
ABSENT: None
ABSTAIN: None

SUBJECT: Mandatory Transportation Systems
Management and Child Care Facilities
Supervisor Tom Powers commented on the need for back-up
legislation to ensure the establishment of a County Transportation
Commission and management of a transportation systems program as
well as mandatory child care. He indicated that discussion should
begin on how far the County wants to go in taking a leadership role
in those areas should the proposal for a voluntary system fail to
materialize or the legislation that the Contra Costa Transportation
Advisory Committee (CCTAC) has asked Senator Daniel Boatwright to
introduce is not successful . He moved that Senator Boatwright be
requested to introduce a spot bill dealing with mandatory
Transportation Systems Management (TSM) in Contra Costa County and
that this issue be further explored and discussed .
Supervisor Tom Torlakson seconded the motion.
Supervisor Powers further commented on the need to resolve
the transportation problem that is becoming quite severe and the
need for the Board to take a leadership role in this area. He.
explained that the second bill would mandate child care facilities
in employment centers .
Supervisor Sunne W. McPeak advised that neither TSM or.
child care require State involvement. She noted that the Board of
Supervisors have the total responsibility as a local jurisdiction to
impose TSM and to develop responses to child care needs .
Supervisor Powers responded that legislation is needed to
specifically define jurisdictional powers , particularly in the area
of enforcement .
Supervisor McPeak advised that she was not in favor of
imposing additional mandates on local jurisdictions when there has
been no preliminary discussion as to what is needed or a procedure
developed to obtain specific results .
Supervisor Robert I . Schroder advised that he could not
support the motion because it indicated a lack of good faith in
negotiations taking place with representatives of the cities on CCTAC .
Supervisor Torlakson suggested having the matter further
reviewed by the Planning, Transportation, Growth and Development
Committee at its meeting on Monday.
Supervisor Powers proposed conferring with Senator
Boatwright on the issue . He withdrew his original motion.
Supervisor Powers then moved that staff be- authorized to
inquire of Senator Boatwright if the spot bill he is currently
introducing on behalf of CCTAC will accomplish a mandatory transpor-
tation systems management program and a mandatory child care program
to be implemented by the County if it is determined by the Board of
Supervisors that those programs cannot be instituted voluntarily.
Supervisor Torlakson seconded the motion.

Supervisor Schroder advised that he would be voting
against the motion because he did not want to give any indication to
the cities that the Board is involved in a power play and not
willing to cooperate with them.
Thereupon, Supervisor McPeak moved to table the motion
pending review by the Planning, Transportation, Growth and
Development Committee with a report to the Board on the issues as
noted above . Supervisor Schroder seconded the motion. The vote on
the motion to table was:
AYES: Supervisors Schroder, McPeak
NOES: Supervisors Powers , Torlakson, Fanden
The motion failed to carry.
Supervisor Powers advised that he did not believe voting
for his motion is a power play. He advised that all jurisdictions
within this County should be working together to solve the traffic
problems .
The Chairwoman then called for the vote on the original
motion.

NOES: Supervisors Schroder, McPeak
