The Board on February 12, 1985 deferred to this date its decision on the appeal of Discovery Bay Property Owners Association from the Board of Appeals decision granting Land Use Permit No . 2082-84 to Anneliese Domingo Valentine (applicant and owner) to establish a home occupation beauty shop in the Discovery Bay area . Supervisor Torlakson advised that the Discovery Bay Property Owners Association at this time is working on revisions to its Covenants , Conditions and Restriction (CC & R's) which would modify restrictions with respect to certain home occupations . Supervisor Torlakson further advised that if Mrs . Valentine would withdraw her application, the Property Owners Association is prepared to withdraw its appeal , and suggested that if the applicant does not wish to withdraw, but agrees to a con- tinuation, the matter could be continued while the Property Owners Association proceeds with modifications to its CC &R's . Mrs . Valentine thereupon advised that she desire the Board to render a decision at this time . Supervisor Torlakson advised that although granting the appeal appears to be against the spirit of some of the goals on which the community is now working, he would have to recommend against the applicant and for granting the appeal . Supervisor McPeak commented that it appeared that Supervisor Torlakson and the Property Owners Association were just about to work out the problem of regulation on home occupations , and that she could not agree to granting the appeal and denying the land use permit at this time . IT IS BY THE BOARD ORDERED that the appeal of the Discovery Bay Property Owners Association on the granting of Land Use Permit 2082-84 is GRANTED , and therefore Land Use Permit 20-82-84 is DENIED . 1 hereby cerlPy th,t thls Is a tnte and correct copy of on action taken and entered on the minutes of#w Board of Supervtscrs on the date shown, ATTESTED: - 71. _ - a'l, l i'ts_.... ..
