SUBJECT: CONDITIONAL SUPPORT OF SENATE BILL 190 (FORAM)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. Conditionally support Senate Bill 190 (Foran) , implementing the California Fingerprint
Identification System, provided the bill is amended to include funding for the additional
costs that county justice agencies would incur.
2. Request assistance of Contra Costa's legislative delegation in amending the bill.
FINANCIAL IMPACT:
Senate Bill 190 (Foran) would provide partial funding for the equipment needed by counties
to participate in the California Fingerprint Identification System (CAL-ID) . However, the
bill does not recognize the fiscal impact such a powerful law enforcement tool would have
on the county justice agencies, such as the District Attorney, Public Defender, Probation,
courts, and the jails. Caseload increases may be substantial, thereby increasing county
costs to process additional offenders.
REASONS FOR RECOMMENDATION/BACKGROUND:
On March 4, your Board referred to the County Administrator's Office the preparation of a
report on the CAL-ID System .and also asked for our recommendation on SB 190 (Foran) which
provides for the implementation of such a system within California. This Office is
currently preparing a detailed report on the subject for submission to your Board in the
near future. The purpose of this recommendation is to alert you that SB 190 comes up for
heAE� in ry Senate Judiciaon March 26 and that it is important for this County to take
a position on thebil at this time.
Basically, the California Fingerprint Identification System CCAL-ID) represents a major new
advance in technology which permits the automated storage, retrieval, and classification
of fingerprints. It is based on technology developed in Japan and exported to this country.
It promises to become a powerful law enforcement tool which will increase arrests and
provide quality evidence for prosecution. San Francisco currently has such a system, and
has found it to be a very effective tool for solving crimes and arresting offenders;
however, there has been a significant impact on the rest of the system, including the
District Attorney, Public Defender, courts, and the jails.
The Attorney General's Office has, for some time, had a California Identification System
Operational Advisory Committee. Assistant Sheriff Jerry Mitosinka has been a member of
that committee. Its purpose is to develop an operational plan for the implementation of

the CAL-ID System. One of the issues identified in that planning forum by some members
has been the significant impact such a system will have on county justice agencies. The
committee, however, has not dealt with this issue in any substantive way; thus, it is the
recommendation of this Office that your Board support SB 190 only on the condition that
the Legislature recognize and document the extent of the fiscal impact upon county justice
agencies and provide for the funding of such impact as part of the legislation. Although
participation in the system is voluntary on the part of counties, it becomes very difficult
not to accept such a system when it promises to be a powerful law enforcement tool for the
solving of crimes and arrest of criminals. The Sheriff supports these recommendations.
