County SUBJECT: Adjustment of LAFCO Processing Fees SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION I . RECOMMENDATION: Acknowledge receipt of report from County Administrator advising that the Local Agency Formation Commission has increased fees effective March 16 ;" 1985. II. FINANCIAL IMPACT: In calendar year 1984 fees amounting to $18 ,650 were generated from 64 parcels. With the new fee schedule, a total of approximately $25, 450 is anticipated during calendar year 1985. The Local Agency Formation Commission budget for fiscal year 1984-1985 is $159 , 535. III . REASONS FOR RECOMMENDATION/BACKGOUND During the budget review for the 1984-1985 fiscal year, your Board inquired about an adjustment in Local Agency Formation Commission processing fees. This matter was brought to the attention of the Local Agency Formation Commission in August of 1984, but the Commission decided not to pursue a fee increase pending a determination on Proposition 36 on the November 6, 1984 ballot. With the defeat of Proposition 36 , this matter was again taken under active review and comparative data on processing fees in other urban California counties obtained. As a result the Local Agency Formation Commission increased fees by $50 per application for the two categories of fees for parcels of 25 acres or less, and created a new category for parcels in excess of 25 acres. The current schedule is shown on the attachment. The estimated revenue of $25,450 is based on 25 parcels in the "a. " category, 15 in the "b. " category, and 24 in the "c. " category. The Local Agency Formation Commission is authorized by statute to fix fees for processing applications after public notice and hearing. These actions have been taken and, therefore, no further action is required of the Board of Supervisors. ATTESTED Building Inspection PHIL BATCHELOR, CLERK OF THE BOARD OF Planning SUPERVISORS AND COUNTY ADMINISTRATOR County Counsel j M382/7-euditor By ssessor � Exhibit A LOCAL AGENCY FORMATION COMMISSION (LAFCQ) OF CONTRA COSTA COUNTY Schedule of Processing ,Fees Applications submitted to this Commission shall be subject to the following processing fees according to size of the affected area: a. areas of 2.5 acres or less $250.00 b. areas larger than 2.5 acres, but not larger than 25 acres 400.00 C. areas larger than 25 acres 550.00 If an application affects two or more separate areas, a fee will be charged for each such area. A single fee will be charged for an applica- tion to concurrently revise boundaries of two or more agencies by annexing or detaching the same area. If the same area is the subject of two or more applications to separately change boundaries of different agencies, a fee will be charged for each such application. Payment Fees are due and payable at the time an application is filed with the Executive Officer. No further action will be taken until the subject fees have been paid. Exceptions The Commission may waive or adjust application processing fees upon finding justification in order to further the purpose of LAFCO enabling legislation. Refunds If an application is withdrawn by written request of the applicant within one year of being filed with the Executive Officer and before it has been placed on the Commission's agenda, the processing fee will be refunded less $100.00 for handling. California Environmental Quality Act of 1970 (CEQA) If, pursuant to CEQA, the Commission becomes responsible for preparation of an Environmental Impact Report (EIR) with respect to processing an applica-tion; the applicant shall pay the cost of preparing the EIR. c , l I I
