HomeMy WebLinkAboutMINUTES - 03121985 - T.8 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on March 12, 1985 , by the following vote: I AYES: Supervisors Powers , Torlakson and Fanden NOES: None ABSENT: Supervisors Schroder and McPeak ABSTAIN: None SUBJECT: Hearing on the recommendation of the County Planning Commission with respect to rezoning application 2617-RZ and Development Plan 3056-84 filed by Ross/Nikitin Architects (Applicant ) and Buscaglia/Bales (Owners ) to rezone land in the Pacheco area . This being the time for hearing on the recommendation of the County Planning Commission with respect to rezoning application 2617-RZ filed by Ross/Nikitin Architects (Applicant ) and Buscaglia/ Bales (Owners ) to rezone . 3 acres in the Pacheco area from Single Family Residential .District (R-6) to Multiple Family Residential District (M-17) and for Development Plan 3056-84 for a 4 unit apart- ment with variances for lot coverage , front setbacks and sideyard setbacks , lot coverage and a building 24 feet high within 50 feet of a single family residential zone; and Harvey Bragdon, Assistant Director of Planning, having described the property site and having advised that a Negative Declaration of Environmental Sigificance was posted for 2617-RZ and Development Plan 3055-84; and The Chairwoman having opened the public hearing and , no one having appeared in opposition, the public hearing was closed; and The Board having considered the matter , IT IS ORDERED that rezoning application 2617-RZ and Development Plan 3056-84 are APPROVED , subject to conditions for Development Plan 3056-84 (Exhibit A attached hereto and by reference made a part hereof) as recommended by the County Planning Commission and the Board hereby adopts the Planning Commission' s reasons as set forth in its Resolution No . 8-1985 as its determination for this decision. IT IS FURTHER ORDERED that Ordinance No . 85-18 giving effect to the aforesaid rezoning is INTRODUCED , reading waived and March 26, 1985 is set for adoption of same . Development shall be for four units as generally shown on the Staff Study dated December 13, 1984. 2. The proposed buildings shall be similar to that shown on submitted plans. Prior to the issuance of a building permit elevations and architectural design of the building and building roofing materials shall be submitted for final review and approval by the County Aoning Administrator. The roofs and exterior walls of the building shall be free of such objects as air conditioning or utility equipment, television aerials, etc., or screened from view. The building shall be finished in wood. 3. Comply with the landscape and irrigation requirements as follows: A. A landscaping program shall be submitted for review and approval of the Zoning Administrator prior to issuance of building permits. Suitable screening type of landscaping shall be planted along. the west boundary of the site. A cost estimate shall be submitted with the landscaping program plan. The plan shall be submitted for review and approval 30 days prior to. anticipated request for building permits.; B. California native species shall be used as much as possible. All trees shall be 15 gallon size, all shrubs shall be 5 gallon size. Existing trees shall be retained as much as possible. C. Perimeter of the site shall be fenced with a 6 foot high solid wood fence. Within 20 feet of Dalton Lane the fence can be reduced to three feet. It can also be reduced to three feet between the proposed building and Aspen Drive. The backyard areas of each apartment shall be separated by a 6 foot high solid wood fence. 4. The site lighting shall be of low intensity and shall be deflected to shine only onto the site. The Zoning Administrator shall review and approve exterior lighting details prior to issuance of building permits. 5. Comply with the requirements of the Contra Costa Consolidated Fire District. 6. If archaeologic materials are uncovered during grading, trenching or other on-site excavation, earthwork within 30 ml eters of these materials shall be stopped until a professional archaeologist who is certified by the Society for California Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an opportunity to evaluate the significance of the ifind and suggest appropriate mitigation measures, if they are deemed necessary. 7. Comply with the requirements of the Central Contra Costa Sanitary District. 8. Each unit sh.411 have address numbers that are clearly visable to Dalton Drive. 9. Each unit shall be equipped with ani automatic roll-up garage door opener. EME A I Pa4e 1 of 3 i .� 3056-84 Page 2 10. The design and color of any identification signs at the front of the property shall be reviewed and approved by the Zoning Administrator. Signs shall be kept low. 11. Each unit shall have separate laundry facilities, garage collection facilities and have at least 50 cubic feet of storage space in addition to normal closet space. 12. Comply with the requirements of the park fee ordinance. 13. Each living unit shall be provided with fire district approved smoke detectors. The detectors shall be mounted on the ceiling at a point centrally located in the corridor or area giving access to rooms used for sleeping purposes. 14. The zoning variances are approved as requested; they meet the requirements of Section 26-2.2006 of the County Ordinance Code. 15. Comply with the requirements of the Public Works Department as follows: A. Unless exceptions are specifically granted, comply with'the requirements of Division 1006 (Road Dedication and Setbacks) of the County Ordinance Code. This includes the following: 1. Convey to the County, by Offer of Dedication, 14 feet of additional right of way on Aspen Drive as required for the planned future width of 54 feet and additional right of way for a 30-foot radius return at the intersection of Aspen Drive and Dalton Lane. 2. Construct curb, 4-foot 6-inch sidewalk (width measured from curb face) , necessary longitudinal and transverse drainage, and pavement widening on Aspen Drive. The face of curb shall be located 18 feet from the centerline of the street. 3. Construct 4-foot 6-inch sidewalk (width measured from curb face) along the frontage of the property on Dalton Lane. 4. Submit improvement plans to. the Public Works Department, Land Development Division, for review; pay the inspection fee, plan review fee and applicable lighting fees. B. Prevent storm drainage, originating on the property and conveyed in a concentrated manner, from draining across the sidewalk or on driveways. C. Install all new utility distibution. servic.es underground. D. Construct road . improvements! in the Pacheco area as directed by the Public Works Department or, as an option, contribute $1,200 per dwelling unit to the County Road Deficiency Trust Fund (Fund No. 8192.00-0800) designated towards road improvements in the Pacheco area prior to the issuance of a building permiit. i Page 2 of 3 3056-84 Page 3 I The following statements fare not conditions of approval. However, you should be aware of them prior_ to requesting building permits. A. Building Inspection Department: 1. A grading permit may be required for the earthwork necessary to develop all parcels in the above minor subdivision. 2. Submit four (4) copies of plans showing the existing contours, the extent of the proposed grading, drainage improvements and general site development. 3. The plans accompanying the application for building permits shall show the existing contours, the extent of the proposed grading and drainage improve- ments, and be reviewed by the Grading Section prior to issuance. 4. Prior to the issuance of building and/or grading permits in the above minor subdivision, a preliminary soil investigation report, prepared by a licensed soil engineer will be required. It shall report on the ability of the site to support the improvements anticipated, and shall include recommended foundations designs to achieve maximum stability of the proposed structures. 5. A licensed soil engineer may be required to control grading operations and to report on the ability of the site to support the improvements anticipated. 6.
