HomeMy WebLinkAboutMINUTES - 03121985 - T.7 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY , CALIFORNIA Adopted this Order on March 12, 1985 , by the following vote: i AYES: Supervisors Powers , Torlakson and Fanden i NOES: None ABSENT: Supervisors Schroder and McPeak ABSTAIN: None I SUBJECT: Hearing on recommendation of the County Planning Commission with respect to rezoning application 2616-RZ, filed by .Bellecci & Associates (Applicant ) and South Forty Partnership (Owners ) to rezone land , and to consider a tentative subdivision map (Subdivision 6529) , in the Oakley area . This being the time ' for hearing on the recommendation of the County Planning Commission with respect to rezoning application 2616-RZ filed by Bellecci & Associates (Applicant ) and South Forty Partnership (Owners ) to rezone approximately 27 acres of land from General Agricultural District (A-2) to Single Family Residential District (R-40) , and to consider a tentative subdivision map (Subdivision 6529) in the Oakley area; and Harvey Bragdon , Assistant Director of Planning, having described the property site and having advised that a Negative Declaration of Environmental Significance was posted on January 4, 1985; and i i The Chairwoman having opened the public hearing and , no one having appeared in oppositon , ! the public hearing was closed; and The Board having considered the matter , IT IS ORDERED that rezoning application 2616-RZ is APPROVED as recommended by the County Planning Commission and the Board hereby adopts the Planning Commission's reasons as set forth in its Resolution No . 9-1985 as its determinations : for this decision . i - IT IS FURTHER ORDERED that the tentative subdivision map for Subdivision 6529 is APPROVED subject to conditions set forth in Exhibit A, attached hereto and by reference made a part hereof , as recommended by the County Planning Commission, and subject to the applicant agreeing to participate in the funding of fire facilities in the Oakley area. This application is contingently approved for 24 lots as generally shown on the tentative map dated received October 19, 1984, subject to adoption of County File 2616-RZ, by thelBoard of Supervisors. 2. The applicant shall comply with the Park Dedication Ordinance for 24 residential lots . 3. Comply with the recommendation of the County Geologist as follows: Prior to recording the final map or issuance of any grading or building permit on parcels created by this subdivision, applicant shall submit a soil and foundation report to the Planning Department for review and approval . The report should evaluate and mitigate any potential damage from earthquake-induced liquefaction. Allow 45 days for review and approval . Building Department permit plans shall implement approved recommendations of the soil and foundation report. 4. If archaeologic materials are uncovered during grading, trenching or other on-site excavation, earthwork within 30 meters of these materials shall be stopped until a professional archaeologist who is certified by the Society for California Archae- ology (SCA) and/or the Society of Professional Archaeology (SOPA) has had an oppor- tunity to evaluate the significance of the find and suggest appropriate mitigation measures, if they are deemed necessary. 5. This subdivision is conditionally approved, subject to the applicant obtaining the necessary approval from the County Health Services Department for the utili- zation of individual sewage disposal on each parcel . 6. Comply with the requirements of Public Works Department as follows: A. In accordance with Section 924.006 of the County Ordinance Code, this subdivision shall conform to the provisions of the County Subdivision Ordinance (Title 9) . Any exceptions therefrom must be specifically listed in this conditional approval statement. B. Convey to the County, by Offer of Dedication, additional right of way on Neroly Road as required for the planned future width of 64 feet. C. Abutter's rights of access along Neroly Road, except for the intersection and driveway access to Loth No. 5 areas shall be relinquished. The relinquishment shall include the richt of wav returns of the affected subdivisions. D. All interior subdivision streets shall be dedicated to the County and constructed1to County public road standards. E. Construct curb', necessary Ilongitudinal and transverse drainage, and pavement widening on NerolylRoad. The face of curb shall be located 40 feet from the Southern Pacific Railroad right of way line. F. Construct LinejD, Drainage Area 56, along the subdivision frontage and off-site a distance of approximately 1,750 feet to East Antioch Creek on the north side of the southern Pacific Railroad. Extend Line D al.onq Neroly Road to the south easterly property corner utilizing a smaller pipe, if feasible, in terms of surface elevation. I H. Comply with the drainage fee requirements for Drainage Area 56 as adopted by the Board of Supervisors. I. Furnish proof to the Public Works Department, Land Development Division, of the acquisition of all necessary rights of entry, permits and/or easements for the construction of off-site, temporary or permanent, road and drainage improvements. i J. Mitigate the impacts of traffic from this development by: 1. Constructing off-site road improvements in the Oakley area as designated by the Public Works Department OR, at the developer's option, 2. Prior to obtaining buildinq permits, contribute $1,300 per dwelling unit to a County Trust Fund (819200-0800) designated toward road improvements in the Oakley area. Upon adoption of a road fee ordinance in this area, these funds will he transferred to the appropriate account and credited toward the subject property. THE FOLLOWING STATEMENT IS ADVISORY ONLY AND DOES NOT CONSTITUTE A CONDITION OF APPROVAL . I Building Inspection Department: 1 . The project will require a preliminary soil investigation report. 2.
