SUBJECT: Hearing on recommendation of the County Planning
Commission with respect to rezoning application 2611-RZ
and LUP 2208-84, filed by Charles A. Quinn (applicant and
owner) to rezone land in the Pacheco/Vine Hill Area
This being the time for hearing on the recommendation of
the County Planning Commission with respect to rezoning application
2611-RZ filed by Charles A. Quinn , applicant and owner , to rezone
approximately 0 .28 acres fronting on the east side of Pacheco
Boulevard , approximately 350 feet south of the A.T .S .F . Railroad
underpass (4653 Pacheco Boulevard) in the Pacheco/Vine Hill area ,
from Single Family Residential District (R-7) to Light Industrial
District (L-1 ) , and for approval of Land Use Permit #2208-84, for a
commercial building with variances to off-street parking and
required sideyard setback; and
Harvey Bragdon , Assistant Director of Planning, having
described the property site and having advised that a Negative
Declaration of Environmental Significance was posted on both
applications ; and
The Chairwoman having opened the public hearing, and no
one having appeared in opposition , the public hearing was closed;
and
The Board having considered the matter , IT IS ORDERED that
rezoning application 2611-RZ ,; and Land Use Permit No . 2208-84 , sub-
ject to the conditions attached hereto as Exhibit A , and by reference
made a part hereof , are APPROVED as recommended by the County
Planning Commission , and the Board hereby adopts the Planning
Commission' s reasons as set forth in its Resolution No . 10-1985 as
its determinations for this decision.
IT IS FURTHER ORDERED that Ordinance No. 85-16 giving
effect to the aforesaid rezoning is INTRODUCED , reading waived and
March 26, 1985 is set for adoption of same .

CONDITIONS OF APPROVAL FOR LAND USE PERMIT 2208-84:
1. The development shall be as generally shown on the Staff Study dated January 15,
1985, subject to final review and approval by the Zoning Administrator of the site and
floor plans, and building elevations, and subject to the conditions listed below. This
application is conditionally approved pending adoption by the Board of Supervisors of
the concurrent application 2611-RZ.

2. This application is approved for warehouse uses only. Commercial service and sales
(retail or wholesale) operations are expressly prohibited. Outside storage of
materials or operation-related vehicles are prohibited. Proposed use and/or floor
plan changes shall be subject to prior review and approval of the Zoning Adminis-
trator. No tractor-trailer vehicles shall be operated in connection with the approved
activities.
3. Prior to the issuance of a building permit, elevations and architectural design of the
proposed building shall be subject to final review and approval of the Zoning
Administrator. The applicant shall provide samples of the exterior materials to be
used including identification of colors. Buildings and doors shall be of an earthtone
color and there shall be no unpainted exposed metal. The north, east and west walls
of the building shall be. finished in a manner so that a climbing vine can grow up the
side of the building. These walls shall include architectural details to break-up the
long blank-wall effect.
4. Prior to issuance of a building permit, submit a landscape and irrigation plan for
review and approval of the Zoning Administrator. Approved landscaping and
irrigation shall be installed prior to occupancy. All approved landscaping shall be
maintained in good condition. The landscape plan shall provide as follows:
A. Landscaping of the area between the front property line and edge of curb
compatible with County sight distance restrictions. Berms around the parking
area shall be provided to screen this area.
B. A suitable climbing vine along the base of the north, east and south sides of the
building.
C. All trees shall be a minimum 15 gallon size and shrubs shall be a minimum 5
gallon size. California native species shall be used as much as possible.
5. All signs shall be subject to the review and approval of the Zoning Administrator. No
other outside displays are permitted.
6. The roll-up door shall remain closed Iduring business hours except when being used for
loading operation. Trash bins shall be located within the warehouse except on the day
of service pick-up. This condition shall be posted and remain visible at all times to
business personnel.

7. Within 60-days of the adoption of the concurrent application, County File 2611-
RZ, all non-conforming uses on the site, car wrecks and trash in the abutting
County drainage ditch shall be eliminated.
8. The roof and exterior walls of the proposed building shall be free of all objects,
e.g., television aerials, air condition units, water or electric meters, etc., or
screened from view.
9. Variances for a five (5) foot sideyard is granted; it meets the requirements of
Section 26-2.2008 of the County Code.
10. Comply with the requirements of the Public Works Department as follows:
A. Unless exceptions are specifically granted, comply with the requirements
of Division 1006 (Road Dedication and Setbacks) of the County Ordinance
Code. This includes the following:
B. Convey to the County by Offer of Dedication, 70 feet of right of way
along the southeast corner of the parcel for the planned future inter-
section.
C. Abutter' s rights of access along the entire frontage of relocated
Pacheco Boulevard shall be relinquished. The relinquishment shall
include the right of way return of the intersection.
D. Construct curb, 6-foot 6-inch sidewalk (width measured from curb face),
necessary longitudinal and transverse drainage, and pavement widening
along the -present Pacheco Boulevard. = The face of curb shall he located
20 feet from the centerline.
E. Prevent storm drainage, originating on the property and conveyed in a
concentrated manner, from draining across the sidewalk or on driveways.
F. Install all new utility distribution services underground.
G. Eliminate the westerly driveway to avoid creating an hazardous condition.
H. Submit improvement plans prepared by a registered civil engineer
to the Public Works Department, Land Development Division, for review;
pay the inspection, plan review and applicable lighting fees. These
plans shall include any necessary traffic signing and striping plans
for review by the County Traffic Engineer. The improvement plans shall
be submitted to the Public Works Department, Land Development Division,
prior to the issuance of any1building permit. The review of improvement
plans and payment of all fees shall be completed prior to the clearance
of any building for final ijnspection by the Public Works Department.
If final inspection is requested prior . to construction of improve-
ments, the applicant shall )execute a road improvement agreement with
Contra Gosta County and post the bonds required by the agreement to
guarantee completion of the work.
I. In accordance with Section 82-2.014 of the County Ordinance Code, this
development shall conform the •requirements -of Division 914 (Drainage).

J. Construct road improvements along Pacheco Boulevard as directed by the
Public Works Department or, as an option, contribute $1.35 per square
foot of gross floor space to the County Road Deficiency Trust Fund
(Fund No. 819200-0800) designated towards road improvements along
Pacheco Boulevard prior to the issuance of a building permit.
K. The -following exception to Divisions 914 and 1.006 is permitted for
this project:
1. Section 1006-2.402, "Requirements - Generally", provided a deferred
improvement' agreement is executed requiring the owners of the
property involved in Permit 2208-84 to:
a. Construct curb, 6-foot 6-inch sidewalk (width measured from
curb face) , necessary longitudinal and transverse drainage
and pavement widening on relocated Pacheco Boulevard. The
face of curb should be located 10 feet from the right of way
line.
b. Submit improvement plans to the Public Works Department, Land
Development Division (at the time the deferred improvement
agreement is called up), for review; pay the inspection fee,
plan review fee and applicable lighting fees.
THE FOLLOWING STATEMENTS ARE ADVISORY ONLY AND DO NOT CONSTITUTE
CONDITIONS OF APPROVAL.
A. Comply with the requirements of the Contra Costa Consolidated Fire District per
12/7/84 letter.
B. Comply with the requirements of the Mountain View Sanitary District per letter of
12/13/84.
C. Building Inspection Department:
I. Grading plans are required to show proposed fill and drainage provisions. The
plans should specify how excess fill material will be disposed of.
