7 The Board of Supervisors , as ex officio the Board of
8 Supervisors of the Contra Costa County Flood Control and Water
9 Conservation District , by vote of two- thirds or more of its mem-
10 bers , RESOLVES THAT:
11 Pursuant to West ' s Water Code-Appendix Sec. 63-5 and Deering ' s
12 Water-Uncodified Acts , Act 1656, Sec. 5 , the Contra Costa County
13 Flood Control and Water Conservation District intends to construct
14 a storm drain facility, a public improvement , and, in connection
15 therewith, acquire an interest in certain real property.
16 The property to be acquired is generally located in the
17 Richmond area east of 3rd Street and consists of one (1 ) parcel
18 within the proposed site of the San Pablo Creek, U. S. Army Corps
19 of Engineers project .
20 Said property is more particularly described in Appendix "A" ,
21 attached hereto and incorporated herein by this reference.
22 On February 19, 198591 this Board passed a resolution of inten-
23 tion to adopt is resolution of necessity for the acquisition by
24
eminent domain) of the property described in Appendix "A" hereto
25
and set March ;12, 1985 , at 10 : 30 a.m. , in its Chambers in the
26 Administration, Building, 651 Pine Street , Martinez , California, as
27 the time and palace for the hearing thereon (Resolution No. 85/88) .
28 The hearing was held at that time and place, and upon the evi-

1 dence presented to it this Board finds , determines and hereby
2 declares the foillowing :
3 1 . The public interest and necessity require the proposed
4 project ;
5 2. The proposed project is planned and located in the manner
6 which will be most compatible with the greatest public good and
7 the least private injury ;
8 3. The property described herein is necessary for the pro-
9 posed project , and
10 4. The offer required by Section 7267. 2 of the Government
11 Code has been made to the owner or owners of record.
12 The County Counsel of this County is hereby AUTHORIZED AND
13 EMPOWERED:
14 To acquire in the County ' s name , by condemnation, the titles ,
15 easements and rights-of-way hereinafter described ; in and to said
16 real property or interest ( s) therein, in accordance with the pro-
17 visions of eminent domain in the Code of Civil Procedure and the
18 Constitution of California : Parcel 1345 is to be acquired in fee
19 simple.
20 To prepare and prosecute in the County ' s name such proceedings
21 in the proper court as are necessary for such acquisition ; and
22 PASSED and ADOPTED on March 12, 1985 by the following vote:
23 AYES: Supervisors Powers , Fanden, Torlakson and McPeak
24 NOES: ; None
25 ABSENT: Supervisor Schroder
26 I HEREBY CERTIFY that the foregoing resolution was duly and
27 regularly introduced, palssed and adopted by the vote of two-thirds
28 or more of the Board of Supervisors of Contra Costa County,

1 California, as clerk of the Board of Supervisors of the Contra
2 Costa County Flood Control and Water Conservation District , at a
3 meeting of said Board on the date indicated.

at Page 7, Official Records, of Contra Costa County, described as follows:
Beginning at a point on the west line of said Lot F that bears South 81 feet from
the northwest corner thereof; thence North 790 East 280.15 feet; thence East 25
feet to the east line of said Lot F; thence along the boundary of said Lot F the
following courses: North 209.55 feet, South 410 West 52.00 feet, South 61045'
West 296.34 feet, West 5.18 feet, and South 81.00 feet to the point of beginning.
Containing 0.87 acres more or less.
