Proposed Policy for Implementation of Mandatory Solid
SUBJECT: Waste Subscription Ordinance
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION
It is recommended that the Board of Supervisors APPROVE the proposed policy
for implementation of Mandatory Solid Waste Subscription Ordinance as
submitted by the Health Services Department, Environmental Health Division.-

On February 12 , 1985 the Board of Supervisors adopted a mandatory solid
waste subscription ordinance for the unincorporated area of Contra Costa
County. In accordance with the ordinance provisions, the Health Services
Department, Environmental Health Division, has developed the attached
proposed policy for implementation of said ordinance.

MANDATORY SOLID WASTE SUBSCRIPTION ORDINANCE
PROPOSED IMPLEMENTATION POLICY
Policy:
The Environmental Health Division, Health Services Department, will enforce the
Mandatory Solid Waste Subscription Ordinance for the unincorporated area as it
has enforced similar ordinances in cities with the following exception:
Owners of properties where there is no weekly solid waste collection service will
not be required to subscribe to such service. The Environmental Health Division
will not survey such remote areas to determine solid waste storage or disposal
practices. Upon receiving a complaint about storage or disposal practices at a
remote premises, the district Environmental Health Inspector will investigate
and work with the owner to reach a mutually agreeable resolution of any problem.
Procedure for areas having weekly solid waste collection service:
1. Upon receiving a complaint regarding solid waste storage or accumulation,
the district Environmental Health Inspector will mail to the owner and/or
occupant of the premises the form letter (A) requesting the people to
correct the alleged violation and informing them of the requirement to
subscribe to the local collection service. See form letter attached.
2. If the problem has not been corrected at the end of the ten day time
period allowed, the district Environmental Health Inspector will investi-
gate and, if necessary, issue the formal abatement notice. See form
letter (C) attached.
This notice will be accompanied by an itemized estimate of costs including
clean up, weekly collection service, and expenses of the Environmental
Health Division.
3. The district Environmental Health Inspector will inspect the premises on
the scheduled follow up date and if the premises have not been cleaned, he/she
will order the collector to clean the property and if the owner has not
subscribed to weekly collection service, the Environmental Health
Inspector will order the collector to start providing weekly collection
service.
4. Following clean up and/or start of weekly collection service, the
Environmental Health Inspector will mail a bill to the owner.
5. If the bill is not paid within thirty days, the Environmental Health
Inspector will file appropriate documentation necessary to have a lien
placed on the property to recover the county's costs.

Procedure for areas without weekly solid waste collection service:
I
A. Upon receiving a complaint regarding solid waste storage or accumulation,
the district Environmental Health Inspector will inspect the premises to
determine if there is a violation. If a violation is verified, the
Environmental Health Inspector will inform the owner/occupant of the
following. options:

1. Haul his/her own: solid waste to a disposal site weekly;
2. Subscribe to a weekly solid waste collection service;
3. Institute a resource recovery system that will not create a nuisance.
