HomeMy WebLinkAboutMINUTES - 03121985 - 1.16 TQ: BOARD OF SUPERVISORS Contra FROM: Phil Batchelor, County Administrator Costa DATE: March 4 , 1985 County SUBJECT: Legislation: Senate Bill 535 SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION; Adopt a position of support for SB 535 (Watson) which would repeal authorization for the issuance of a "stay-away" order which has no specific expiration date on its face. A BACKGROUND; One of the items in the Board' s 1985 legislative program is a request for legislation that would require an expiration date on the face of a "stay-away" order so peace officers would immediately know whether the order is still in force. Senator Watson had introduced legislation in 1984 which provided for such a "stay-away" order, but provided that the order was valid as long as the court had jurisdiction over the defendant. This presents problems for law enforcement personnel, particularly at night and on weekends when the courts are closed, because there is no way to verify whether the court still has jurisdiction and, therefore, whether the order is still valid. The Sheriff requested legislation to require that such an expiration date appear on the face of the order. Senator Watson has now introduced SB 535 as urgency legislation to repeal the entire section on "stay-away" orders, thereby solving the Sheriff ' s problem..
