On or about October 14, 1983, Michael Price was 2 fatally injured as a result of a single car accident occurring 3 on Kirker Pass Road; 3, 696 feet north of North Hess Road, i 4 in an unincorporated area of. Contra Costa County. Claimants 5 refer to and! incorporate herein as Exhibit "A" , without 6 admitting the accuracy of the ontents thereof, the Traffic 7 Collision Report prepared by the California Highway Patrol. 8 5 . Claimants are inforoed and believe that at all 9 relevant times Kirker Pass Roa� was a public roadway owned, 10 maintained, and operated by the County of Contra Costa. At said 11 time and place, said roadway was negligently and carelessly 12 owned, maintained, managed, co trolled, planned, designed and dangerous n 13 constructed. Said property was in a d a ge and defective e tive 14 condition which created a substantial risk of injury to persons 15 using said roadway in a reasonably foreseeable manner, and 16 to persons using said roadway with due care. The names of the agents, servants, and employees 4 of the public entity who are reasonable for said dangerous 5 condition are presently unknown to the claimants. 6 7. As a proximate result of said dangerous and defective 7 condition, and the negligence of the public entity in not 8 properly maintaining, designing, and constructing said roadway, 9 Michael Price was fatally injured when the car in which he was 10 a passenger crossed over the median between the northbound and 11 southbound lanes of Kirker Pass Road, passed through the opposing 12 lanes of traffic, left the confines of the roadway and overturned . 13 while proceeding down the roadway' s sloping embankment. 14 8. Claimants are informed and believe that said public 15 entity had actual and constructive knowledge of the dangerous 16 condition noted above, and that they knew or should have known 17 of the dangerous character of said roadway a sufficient .time 18 prior to October 14, 1983, to have taken measures to correct 19 said condition and to protect those persons who might use said 20 roadway in a reasonably foreseeable manner. Claimants are 21 informed and believe that at all relevant times Kirker Pass 22 Road was a lour-lanerlimited-access, high speed, heavily- 23 traveled roadway. In the years preceding the above-mentioned 24accident, several similar "cross-median" and "off-the-road" 25 accidents occurred as a proximate result of the dangerous 26condition noted above. Many of these prior similar accidents 27 resulted in severe injuries, and in some cases death. 28 MCNAMA"HOUSTON. As a result of the accident, claimants were served 2 on or about November 28, 1984 with First Amended Complaints for 3 the wrongful death of Michael Price. [without admitting the 4 accuracy -of any of the allegations thereof, copies of said 5 complaints are attached hereto as Exhibit "B" and incorporated 6 herein by reference. The amount of damages, if any, for which 7 claimants may be held liable under these complaints is presently 8 unknown. i 9 10 . If liability is imposed upon claimants as a result 10 of the attachld complaints, the County of Contra Costa will 11 have an equitable duty to indemnify the claimants, either 12 wholly or in an amount equal to its relative degree of respon- 13 sibility under the doctrine of comparative fault. (e) Circumstances of occurrence: I On or about said date, at approximately 8:15 p.m. , while Claimant was lawfully operating his automobile containing his eleven year old daughter, he was suddenly and without causeiforced to the curb at the above location by, among others, Deputy Fred Gray and Deputy Ross, both of the Contra Costa County Sheriff's Office; said officers then, without just cause, forcibly removed Claimant from his automoblile, threw him against same, handcuffed him, and then unlawfully assaulted, battered and struck him with fists, night- sticks and boots about the head, face, neck, throat, arms, chest and stomach, thereby proximately causing severe permanent and disabling injuries to Claimant as hereinafter alleged. (f) General description of injury, damages or loss incurred: Injuries to the body and shock and injury to the nervous system and person of Claimant; physical and emotional injuries, the exact extent of which is unknown at this time.
