HomeMy WebLinkAboutMINUTES - 07171984 - T.5 T5 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on July 17 , 1984 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, Torlakson NOES: None ABSENT: Supervisor McPeak ABSTAIN: None SUBJECT: Hearing on recommendation of County Planning Commission with respect to rezoning application 2599-RZ , Merle D. Gilliland (applicant) , and Central Bank (owner) , and approval of Final Development Plan Number 3023-84 in the Pleasant Hill BARTD Station area. This being the time fixed for hearing on recommendation of County Planning Commission with respect to rezoning application 2599-RZ , Merle D. Gilliland (applicant) and Central Bank (owner) to rezone approximately 5 . 37 acres from Planned Unit District (P-1) and Single Family Residential District (R-12) to Planned Unit District (P-1) and approval of Final Development Plan Number 3023-84 in the Pleasant Hill BARTD Station area; and Harvey Bragdon, Assistant Director of Planning having described the property site and having advised that a Negative Declaration of Environmental Significance was posted on this project; and The Chairman having opened the public hearing and, no one having appeared in opposition, the public hearing having been closed; and The Board having considered the matter, IT IS ORDERED that rezoning application 2599-RZ is APPROVED as recommended by the County Planning Commission and Development Plan Number 3023-84 is APPROVED subject to conditions imposed by the Planning Commission as set forth in Exhibit A attached hereto and by reference made a part hereof , and the Board hereby adopts the Planning Commission' s reasons , set forth in its Resolution Number 31/1984 as its determinations .for this decision. IT IS FURTHER ORDERED that Ordinance Number 84-32 giving effect to the aforesaid rezoning is INTRODUCED, reading waived and July 31 , 1984 , is set for adoption of same. Development shall be generally as shown on the plans submitted with the application. Development shall be subject to final review and approval by the County Zoning Administra-tor prior to the issuance of a building permit. 2. Comply with the landscape and irrigation requirements as follows: A. Prior to issuance of a building permit, a landscape and irrigation plan shall be submitted for review and approval by the County Zoning Administrator. A cost estimate or copy of contract for landscaping improvements shall be submitted with the plan. Landscaping and irrigation shall be installed prior to occupancy. B. The proposed trees on the site are to be a minimum of 15 gallons in size. The proposed shrubs on the site are to be a minimum of 5 gallons in size. C. Landscaping shall be installed prior to occupancy for office use. D. Landscaping fronting on Treat Boulevard and Cherry Lane shall be mounded in front of parking areas sufficient to soften automobiles. Mounding and landscap- ing combined shall be designed in these areas to reach an overall height of at least 4 feet. Landscaping installation on each side of the building shall be designed to minimize the impact of the development. E. Setback areas adjacent to residential land uses shall be landscaped in conjunction with the required masonry wall. Landscaping in this area shall include fast- growing trees of a nature that will provide the maximum privacy possible to the adjacent properties. F. Landscaping in parking areas shall be sufficient to minimize the effect of the large paved areas. G. All landscaped areas must be maintained in good condition at all times. 3. Office uses and associated storage areas shall be the only uses permitted with the exception of employee services. Employee services may include limited banking and/or cafeteria uses subject to review and approval by the Zoning Administrator. 4. Comply with parking requirements as follows: A. Parking shall be designed in conformance with the County Parking Ordinance except as provided by these conditions and shall be subject to review by the County Zoning Administrator. B. Adeqaute parking spaces shall be provided on the ratio of 3.3 spaces per 1,000 square feet. 0000411 MEN A Central Bank - 2 C. Landscape curbing may be used as wheel stops allowing vehicle overhang subject to review of the landscaping plan. D. Prior to issuance of the building permit, the applicant shall enter into an agreement with the County to participate in a transportation system manage- ment program which may include but is not necessarily limited to: 1. Establish van pools or a car-pool system. 2. Providing secure bicycle storage areas. 3. Providing BARTD's and/or Central Contra Costa Transit Authority passes to employees. 4. Establishing pay parking areas. 5. Establishment and participation in an association which will be designed to implement a transportation program. E. That Condition 4.(B) does not eliminate the applicant's responsibility to pay any transit fee comparable to that required by the Pleasant Hill BARTD Station Specific Plan. F. That some parking areas be identified as "customer parking" only and that the number and location of these is to be reviewed by the Zoning Administrator prior to the issuance of a building permit. 5. A 6 foot high masonry wall shall be installed along all property lines adjacent to residential uses. The design of the masonry wall shall be subject to review and approval by the Zoning Administrator prior to installation. 6. Comply with the signing requirements as follows: A. There may be two free-standing sign allowed. One at the entrance to the site on Cherry Lane and one facing Treat Boulevard. These signs shall be non- illuminated identification only and may not exceed 5 feet in height from finished grade and 10 square feet in area. Free-standing signs may be located in the setback area, however, they shall be designed in conjunction with the landscape plan. B. All signs shall be subject to the review and approval of the County Zoning Administrator. 7. Prior to issuance of a building permit, elevations and examples of exterior colors and materials for buildings and structures shall be subject to final review and approval by the County Zoning Administrator. The roofs and exterior walls of the buildings shall be free of such objects as air conditioning equipment, television aerials, etc., or screened from view. 8. Exterior lights shall be deflected so that lights shine onto applicant's property and not toward adjacent properties. 9. The applicant shall comply with the requirements of the Contra Costa Consolidated Fire District. 0002 .2 Central Bank - 3 10. The applicant shall pay any fees established by the adoption of Pleasant Hill BARTD Station Specific Plan resulting from the current study as they relate to transit, infrastructure improvements or preparation of the Specific Plan. These fees shall be based on comparable development intensities within the Plan area to be determined by the Zoning Administrator. Fees are to be paid upon adoption of a Plan irrespective of the-Site's includion or exclusion in the Specific Plan area. Fees not covered by participation in the assessment District shall be paid prior to approval of a building permit for the requested changes. 11. The applicant shall agree in writing to participate in a study and its ultimate implementation addressing child care needs. 12. Comply with the requirmenet of the Public Works Department as follows: A. Comply with the conditions of approval for DP 3015-82. B. Construct curb, 5-foot sidewalk (width measured from curb face), necessary longitudinal and transverse drainage, pavement widening along the frontage of Cherry Lane. C. Install street lights along the frontage of Cherry Lane. The final number and location of the lights will be determined by the Traffic Engineer. D. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of Division 914 (Drainage) of the Subdivision Ordinance. E. Provide a driveway connection between this project and DP 3053-83. F. Prior to the issuance of building permits mitigate the impact of traffic from the increase of floor area by paying $3. 18 a square foot on any additional floor area of the total project in excess of 122,000 square feet. The cost of the additional Cherry Lane frontage improvements may be credited against this contribution. This contribution is consistent with fees established by the Board of Supervisors for the Pleasant Hill Bart Stations Specific Plan based on comparable development inten- sities within the Plan Area.
