THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY , CALIFORNIA
Adopted this Order on July 10, 1984 , by the following vote:
AYES: Supervisors Powers , Fanden , Schroder , Torlakson
NOES: None
ABSENT: Supervisor McPeak
ABSTAIN: None
SUBJECTS Proposal for the Interstate Commerce Commission to Impose
Conditions on Railroad Rights-of-Way Abandonments
Supervisor T. Powers referred to the Southern Pacific/
Santa Fe merger and the need for public entities in California to
recognize the impact said merger would have on communities and com-
munity projects in California . In a July 10, 1984, memorandum to
the Board , Supervisor Powers noted that one of the important aspects
of the merger is that the approved merger company will be seeking to
abandon certain duplicated rights-of-way which are located in
California and includes cities and unincorporated areas in Contra
Costa County. Supervisor Powers advised that a major concern of
California cities and counties is that abandoned rights-of-way
should be preserved for transportation purposes and that such
rights-of-way should be required to pass onto local entities at pri-
ces consistent with the valuation as a transportation corridor , not
as high residential , industrial , or commercial land .
Supervisor Powers presented the following recommendations
for consideration by the Board:
1 . That Contra Costa County seek conditions attached to
the Interstate Commerce Commission' s (ICC )
authorization of abandonment of duplicated rights-of-way
so that public entities interested in using the
rights-of-way for continued transportation corridors
be given fair treatment as to negotiation time and
price for said transportation rights-of-way;
2. That a comprehensive study as to specific conditions
be requested of the Interstate Commerce Commission;
3. That the County makes the suggestion to its cities ,
through the Mayors Conference , that they likewise
request the ICC to attach conditions consistent with
the transportation needs of the public;
4. That this issue be referred to the County Supervisors
Association of California for a statewide position;
5. That the local Mayors Conference request the League of
California Cities. make similar requests to the ICC'.
6. That any additional action necessary be taken by state
and/or federal legislators to secure abandoned rights-
of-way in the public domain for transportation pur-
poses when there is a reasonable future need apparent
for such public transportation rights-of-way.
Supervisor T . Torlakson advised that he also has concerns
relative to development proposals in the proximity of railroad
rights-of-way and the need for reviewof this matter .

Board members being in agreement , IT IS ORDERED that the
County Administrator is REQUESTED to analyze the proposal that would
require the Interstate Commerce Commission to give consideration to
public entities interested in using abandoned railroad rights-of-way
for transportation corridors and report to the Board on same .
