SUBJECT: Proposed Amendment to the Swimming Pool Ordinance
In response to the request of the Board , R . W .Giese ,
Director , Building Inspection Department , reported to the Board that
staff from his Department has met with proponents and opponents of
the proposed amendment to the Swimming Pool Ordinance that would
require additional fencing or other alternative measures aimed at
preventing drowning and near drowning of children in backyard
swimming pools .
Board members reviewed the provisions of the proposed
ordinance amendment , and Supervisor T . Powers suggested that
Mr . Guise evaluate manufacturers' products considered for alter-
native measures for swimming pool safety and report to the Board in
60 days as to the reliability of said safety devices . He advised
that he was prepared to recommend the introduction of the ordinance
with the implementation date to be 60 days from the date of adop-
tion .
Don Burns , representing the swimming pool industry,
expressed concern with the implementation date recommended by
Supervisor Powers for the reason that this would not give manufac-
turers of swimming, pool equipment adequate time to develop high
standard safety devices or the Building Inspector sufficient time
to evaluate alternative safety devices . He expressed the belief
that more time should be allowed to develop standards and criteria
for evaluating alternative devices .
Supervisor N . C . Fanden advised that she would support the
60-day implementation date with the understanding that if the
Building Inspector finds that more time is needed for his study, he
will request it from the Board .
Supervisor R . I . Schroder requested that said Ordinance
be distributed to the City Councils within this County since many of
the swimming pools are constructed within the jurisdictions of the
incorporated cities .
Board members being in agreement , IT IS ORDERED that the
Ordinance is INTRODUCED , reading WAIVED , and July 17, 1984 , FIXED as
the time for adoption .
On recommendation of Supervisor Powers , IT IS ORDERED that
the Building Inspector is REQUESTED to review a proposal to provide
for the establishment of a committee to promote a public safety and
awareness program , to keep the Board informed of issues that arise
relative to swimming pools , and to review in one year the effec-
tiveness of the Ordinance .
