Management Regulations ) RESOLUTION NO.
In its capacities as the Board of Supervisors of Contra Costa County and as the
Governing Board of the Contra Costa County, Moraga, Orinda, Riverview and West
Fire Districts, this Board RESOLVES THAT:
Upon recommendation of the Personnel Director, and upon the recommendation of
the County Administrator, Part 18, Deep Class Reassignments, shall be added to
the Personnel Management Regulations adopted by Board Resolution No. 81/1468, as
indicated below:
1801. Reassignment. Deep class incumbents are subject to reassignment
to higher or lower responsibility levels within the class, and to
higher or lower base salary steps within the class, in accordance with
the work assignments of such incumbents which shall be determined and
may be modified from time to time by the appointing authority.
1802. Preliminary Notice. Prior to a downward reassignment the
appointing authority shall advise the incumbent in writing of the pro-
posed action and the reasons for the proposed action and provide the
incumbent an opportunity to respond to the appointing authority within
not less than five calendar days.
1803. Downward Reassignment Order. Downward reassignment shall be
carried out by a written order to the incumbent stating specifically
the reasons for the downward reassignment. A copy of the order shall
be filed with the Director of Personnel .
1804. Appeal from Downward Reassignment Order. The incumbent may
reply in writing to the reassignment order within ten calendar days of
its filing with the Director of Personnel , and may appeal the reassign-
ment order within ten calendar days to the Merit Board. Upon an
appeal from a reassignment order the incumbent shall have the burden of
proof to show that the order was arbitrary or capricious and not in
accordance with the appointing authority's right to direct the work
assignments within the deep class.
180 . Appeal Procedure. Appeals from Downward Reassignment Orders
shall be heard and decided in accordance with Personnel Management
Regulations 1114 through 1128, inclusive.
1806. Applicability. Part 18 of the Personnel Management Regulations
is applicable to all management deep classes.

Merit System Ordinance )
WHEREAS, the Board of Supervisors has established a number of management deep
classes in the Merit System; and
WHEREAS, the reassignment provisions of those deep classes should be modified in
order to bring certain provisions into accord with the Merit System Ordinance;
THE BOARD, in its capacities as the Board of Supervisors of Contra Costa County
and as the Governing Board of the Contra Costa County, Moraga, Orinda, Riverview
and West Fire Districts, RESOLVES that the following deep class resolutions are
amended as indicated below.
1. Health Services Administrator Health Information Systems Specialist, Health
Services Planner/Evaluator Deep Class Resolution No. 83/1063, Section 7:
Reassignments Within Class.
a. Deep class incumbents are subject to reassignment to higher or
lower responsibility levels within the class, and to higher or
lower base salary steps within the class, in accordance with the
work assignments of such incumbents which shall be determined and
may be modified from time to time by the appointing authority.
Downward reassignments are subject to the provisions of Part 18 of
the Personnel Management Regulations.
b. Any incumbent of a deep class who is reassigned between vacant
positions at different responsibility levels or has the functions
of his/her present position increased or decreased sufficient for
placement in a different responsibility level or for placement at a
higher or lower step in the same responsibility level, may have
his/her salary adjusted at the discretion of the appointing
authority to any base salary step in the new or existing respon-
sibility level . However, no such adjustment upward may occur more
frequently than six months following the date of initial or
transfer appointment to the class. An incumbent reassigned down-
ward between responsibility levels or between steps in the same
responsibility level may have his/her salary* Y-rated as defined in
the Salary Regulations as an alternative to immediate salary reduc-
tion. However, in all reassignments, whether within the same level
or between levels, written documentation shall be provided to and
approved by the Director of Persunnel prior to action by the
appointing authority.

2. Administrative Services Officer Deep Class Resolution No. 81/26, ADD
Section 10: Reassignments Within Class.
Deep class incumbents are subject to reassignment to higher or lower
base salary steps within the class, in accordance with the work assign-
ments of such incumbents which shall be determined and may be modified
from time to time by the appointing authority. Downward reassignments
are subject to the provisions of Part 18 of the Personnel Management
Regulations.
3. Deputy District Attorney Deep Class Resolution No. 83/401, Section 3,
Retitle to Reassignments Within Class.
a. Deep class incumbents are subject to reassignment to higher or
lower responsibility levels within the class, and to higher or
lower base salary steps within the class, in accordance with the
work assignments of such incumbents which shall be determined and
may be modified from time to time by the appointing authority.
Downward reassignments are subject to the provisions of Part 18 of
the Personnel Management Regulations.
b. A Deputy District Attorney who meets the minimum qualifications for
Advanced Salary Level Assignment and is assigned by the appointing
authority to the Advanced Level on a permanent basis shall be
placed at Step 1 of the Advanced Level irrespective of whether or
not this results in a salary adjustment of less than five percent
(5%) . Designation of an assignment to Advanced Salary Level is the
sole prerogative" of the County. As additional organization or
operational needs arise, Deputy District Attorney positions may be
added to or deleted from the Advanced Salary Level . Continued
incumbency in any Advanced Assignment shall be dependent on the
incumbent receiving a satisfactory performance evaluation from the
appointing authority or his/her designee immediately preceding
completion of six months tenure in the assignment and annually
thereafter.
4. Management Development Specialist Deep Class Resolution No. 81/155,
Section 9, Retitle to Reassignments Within Class.
a. Deep class incumbents are subject to reassignment to higher or
lower responsibility levels within the class, and to higher or
lower base salary steps within the class, in accordance with the
work assignments of such incumbents which shall be determined and
may be modified from time to time by the appointing authority.
Downward reassignments are subject to the provisions of Part 18 of
the Personnel Management Regulations.
b. Temporary or permanent assignments of a Management Development
Specialist may be made by the appointing authority as follows:

A Management Development .Speciaiist who is reassigned to a vacant
position within the class or who has the responsibility level of
his present postion. increased or decreased, as documented, by the
appointing authority, may have his salary adjusted at the discre-
tion of the appointing authority to any step consistent with the
responsibility level assigned and in accordance with the provisions
of Section 2. This assignment may be a temporary assignment or a
permanent assignment 'at the discretion of the appointing authority.
If an assignement to a higher skill level is permanent at its
inception, the appointing authority must complete a performance
evaluation after six months at that assignment responsibility
level , and may if the performance is unsatisfactory, return the
employee to his previous responsiblity level and salary.
If an assignment is temporary at its inception, the appointing
authority must set an end date for the temporary assignment of no
more than one year authority.
5. Safety Services Specialist Deep Class Resolution No. 82/1358, Section 7,
Retitle to Reassignments Within Class.
a. Deep class incumbents are subject to reassignment to higher or
lower responsibility levels within the class, and to higher or
lower base salary steps within the class, in accordance with the
work assignments of such incumbents which shall be determined and
may be modified from time to time by the appointing authority.
Downward reassignments are subject to the provisions of Part 18 of
the Personnel Management Regulations.
b. Any incumbent of the Safety Services Specialist class who is
reassigned between vacant positions at different responsibility
levels or has the function of his/her present postion increased or
decreased sufficient for placement in a different responsibility
level or for placement at a higher or lower step in the same
responsibility level , may have his salary adjusted at the discre-
tion of the appointing authority to any step in the new or existing
responsibility level . However, no such adjustment upward may occur
more frequently than six months following the date of initial or
transfer appointment to the class. An incumbent reassigned down-
ward between responsiblity levels or between steps in the same
responsibility level may have his/her salary Y-rated as defined in
Section 16 herein as an alternative to immediate salary reduction.
However, in all reassignments, whether within the same level of
between levels, written documentation shall be provided to and
approved by the Director of Personnel prior to action by the
appointing authority.
Effective upon the date of any reassignement as provided for in
this Section 7 and continuing for .a period of six months thereafter
the incumbent will be subject to performance review by the
appointing authority and may be subject to further reassignment or
salary adjustment for unsatisfactory performance.
