SUBJECT: Monies Due Flood Control District from Property Owners Participating in 1982-83
Storm Damage Stream Bank Restoration Program.
Specific Requests or Recommendations & Background & Justification
RECOMMENDATION
It is recommended that the Board of Supervisors, sitting as the governing board of Contra
Costa County Flood Control and Water Conservation District, take the following actions
with regard to monies due the Flood 'Control District by property owners participating
in the 1982 and 1983 United States Department of Agriculture, Soil Conservation Service,
Storm Damage Stream Bank Restoration Program:
1. Authorize the Auditor-Controller to release Mr. Richard H. France from payment of
$606.36; and
2. Authorize the Auditor-Controller to permit payment of $8,298.16 from Mr. and Mrs. Harold
Marsh and $1,624.02 from Ms. Margaret Stephen through 24 monthly, interest free payments.
BACKGROUND
By Board Orders dated January 26, 1982 and March 1, 1983, the Board authorized the Flood
Control District's participation in the 1982 and 1983 Soil Conservation Service Storm
Damage Stream Bank Restoration Program. One of the conditions of participation was that
the property owners affected would pay the 20 percent local cost share required under
the program. Approximately $3,000,000. in stream bank repair work has been completed.
The District entered into agreements with all of the property owners participating in .
the program. These agreements provided for deposit of funds to cover the local share;
unfortunately, actual costs on several of the projects exceeded the deposit amounts.
The District has collected all outstanding amounts except for the following: Mr. Richard H.
France ($606.36), Mr. and Mrs. Harold Marsh ($8,298.16), Ms. Margaret Stephen ($1,624.02) ,
and Ms. Carolyn Kerr ($6,484.14) .
The work on Mr. France' s property on Alhambra Creek was combined with work at another
site on the same creek. Upon receipt of bids, which were significantly higher than the
engineers estimate, Mr. France indicated that he could only afford to pay a portion of
the higher cost and that he would have to withdraw from the program under the terms of
the agreement. Due to the approaching winter, the inability to award the contract with
one of the two sites deleted and the potential monetary loss to the District for engineering
costs already incurred, it was decided that the project should proceed as planned and
that the District should assume his additional costs, if any, beyond his stated financial
capability of $5,014.04.

TIe work on the Marsh and Stephen's properties was included in the 1982 Las Trampas Creek
project. The additional amount due by each of these property owners is the result of
a claim settlement by the Soil Conservation Service with the contractor. Mr. and Mrs. Marsh
have already paid $14,130.41 toward their share of the work, and Ms._ Stephen has already
paid $8,772.04.
The monies due from Ms. Carolyn Kerr will be collected by the County Auditor-Controller
following normal procedures.
