THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on June 12, 1984 by the following vote:
AYES: Supervisors Powers, Schroder, McPeak, Torlakson
NOES: None
ABSENT: Supervisor Fanden
ABSTAIN: None
SUBJECT: Hearing on appeal of Winton Jones from County Planning
Commission approval of application for Subdivision 6412,
and to allow phasing for parcel A of MS 34-83, Bedford
Properties, Inc. , (applicant and owner) , in the Concord
area.
This being the time fixed for hearing on the appeal of
Winton Jones from County Planning Commission approval of application
for Subdivision 6412, and to allow phasing for parcel, A of MS 34-83,
Bedford Properties Inc. , (applicant and owner) in the Concord area;
and
Norm Halvorson, County Planning Department, having
described the project site and advised that this Subdivision was
approved by the County Planning Commission, and in a second action
allowed for the phasing of the development, Mr. Jones then appealed
these decisions; and
The Chairman having opened the public hearing; and
Bud Lake, representing Bedford Properties, applicant,
having appeared and advised the Board of the history of the
subdivision and urged the Board to deny the appeal of Winton Jones;
and
Supervisor Torlakson having inquired as to what aspect
made the phasing of this project different from the original sub-
division; and
Mr. Lake having advised that the major difference of the
phasing project was the timing sequence for developing the sub-
division; and
Winton Jones, 1949 Arnold Industrial Way, Concord,
appellant, having appeared and expressed his concerns regarding the
availability of room for future burial plots in the Memory Gardens
Cemetary, and having also expressed his opposition to a proposed
Assessment District; and
Mr. Jones also having advised that he had never before
experienced any problems with respect to air pollution, but when
Bedford Properties started its earthmoving, and grading operations
without any form of dust control, his Koi fish reproduction was
damaged and his swimming pool was blanketed with dust, and having
then urged the Board to exercise its responsibility to control the
subdivision and to police the activities which are governed in the
County Ordinances; and
Supervisor Powers having commented that if there is acti-
vity being done without a permit it should be referred to the
Building Inspection Department; and
Nathalie Jones, 1949 Arnold Industrial Way, Concord,
advised. the Board that she concurred with the presentation made by
her husband, that she was opposed to the phasing of this sub-
division, and having expressed her concern with respect to the
overflow of water on her property; and

r Mr. Lake having appeared in rebuttal and having advised
i, that the reason for the County involvement with the Assessment
r District was for the purpose of improvements along Arnold Industrial
Highway; and
Supervisor Torlakson having inquired,, as to what was being
done by Bedford Properties with respect to the grading and dust
impact mitigation; and
Mr. Lake having stated that he felt everthing was being
handled in accordance with County standards; and
Supervisor McPeak having inquired as to whether the Public
Works Department could further address the issues of traffic and of
financing improvements; and
Dave Jewett, Assistant Director of Public Works, advised
that requirements for drainage on this subdivision are covered by
County Ordinances, and having advised that the improvement Plans
would be reviewed and approved according to the code; and
Supervisor Powers having commented that he was concerned
about the large amounts of water that are flowing in to the field
areas of the property, and stated that he had some questions
regarding the adequacy of other drainage requirements, and having
recommended that the matter of drainage problems be addressed in a
seperate Board action; and
The Chairman having closed the public hearing; and
Supervisor McPeak having stated that in response to the
staff report and the testimony that had been received at the public
hearing, and based on the Planning Commissions unanimous approval of
this project, she would recommend sustaining the approval of the
project with conditions imposed by the Planning Commission.
Board members having considered the matter, IT IS ORDERED that
the appeal of Winton Jones from County Planning Commission approval of
application for Subdivision 6412 and to allow phasing for parcel A
of MS 34-83 in the Concord area is DENIED.
