HomeMy WebLinkAboutMINUTES - 05081984 - T.6 e THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 8, 1984 , by the following vote: AYES: Supervisors Fanden, Schroder, McPeak, Torlakson NOES: None ABSENT: Supervisor Powers ABSTAIN: None SUBJECT: Hearing on recommendation of County Planning Commission with respect to rezoning application 2556-RZ and Prelimi- nary Development Plan , filed by Bryan & Murphy Associates , Inc . , (applicant ) , and Falender Properties , (owner) to rezone land in the Pleasant Hill area . This being the time fixed for hearing on recommendation of the County Planning Commission with respect to rezoning application 2556-RZ , filed by Bryan and Murphy Associates , Inc . , (applicant) and Falender Properties (owners) to rezone 39.24 acres from Single Family Residential District (R-20) to Planned Unit District (P- 1 ) and approval of a Preliminary Development Plan for 57 Single Family Residential lots in the Pleasant Hill area; and Harvey Bragdon , Assistant Director of Planning having described the property site , and having advised that an Environmental Impact Report was prepared for this property with application for Subdivision Number 5489 in 1979, and except for traffic and .drainage impacts for which the applicant has agreed to appropriate mitigation measures , a Negative Declaration of Environmental Significance was posted on this proposal on October 10, 1983, and also advised that a condition for a drainage require- ment was inadvertantly left off of the list of conditions which were approved by the Planning Commission, and advised that a condition should be added which would require , as fulfillment of the basic collect and convey requirements of Title 9, as follows: Verify that Grayson Creek (West Fork) the intervening drainage system is adequate to convey the required design storm (including the storm waters diverted from DZ 16) and construct any improvements to guarantee adequacy, be added to the conditions of approval ; and The Chairman having opened the public hearing; and Fred Falender , 3701 Mt . Diablo Blvd, Lafayette , owner ` of the subject property., having appeared and having advised that a meeting had been held with the neighbors who would be affected by this project , in order to attempt to work out solutions to some of the issues to which they were opposed; and Mr. Falender having advised that. increased traffic, drainage mita-gation, and proposed lot sizes seemed to be the major concerns of the neighbors who attended the meeting; and Mr . Falender having advised the Board that this project would include a mix of housing from the medium price range up, and also stated that the proposed project would provide housing in an area of the County were there was a need for housing of this nature; and L. Wayne Policz, 1450 Marina Lane , Walnut Creek, builder of the proposed housing project , having appeared and stated that the proposed homes would range in price from $170,000.00 to $200,000.00,,_, and also having advised the Board that , in his opinion, the subje'et site was compatible with the existing neighborhood and that this project would form a buffer when the adjacent property in Pleasant Hill was developed; and James L . Hazard , attornAv, rPnrPCPnti for Reasonable Hillside Development , having appeared and expressed his concerns regarding the Environmental Review Process issued for this project , and having also stated that he felt the Environmental Review Process for this project was inadequate; and Mr . Hazard having also expressed his concerns regarding the grading of the hillside , the drainage for the proposed project , and the proposed lot sizes for this area; and Supervisor McPeak having stated that a question had been raised relating to processes and stated that she did not want to further complicate the public hearing by going into the exact process for Environmental review but recommended that the matter be resolved so' that the hearing could proceed and requested staff to review the Environmental requirements for this project; and Supervisor Torlakson advised that it would be appropriate to move forward with the hearing; and The following persons having appeared in opposition to the proposed project: John Kelly, 985 Iroguois Drive , Pleasant Hill; John M . Hanlon , 2098 Mohawk drive , Pleasant Hill: Steven A Soares , 1009 Pleasant Oaks , Pleasant Hill; Hugh Wang, 2086 Mohawk Drive , Pleasant Hill; Hank DeWitt , 2080 Mohawk Drive , Pleasant Hill; Joe Torosian , 2092 Mohawk Drive , Pleasant Hill; Kirk Swannn , 2080 Buttner Road , Pleasant Hill; Bruce Davis , 3258 Surmont Drive , Lafayette; Mark Robin , 3259 Surmont Drive , Lafayette; Joan Toth, 2052 Mohawk Drive , Pleasant Hill; Donald L . Coffin , 2000 Mohawk Drive , Plesant Hill; Lloyd Shikany, no address submitted for record; The Chairman having advised that he had received a written comment from Deborah Hampton, 3162 Gloria Terrace , Lafayette , in oppo- sition to the proposed project; and Sandy Skaggs , Attorney, representing the applicant , having appeared and stated that his firm had been retained to review what had been issued by the County Planning Staff with respect to the Environmental review process for this project , and stated that in his review he had found no defects in the process , and recommended that if the Board was inclined to favor this project , it declare its intent to approve this project over some period of time , and also requested that the Board recommend that the County review the Environmental process; and Fred Falender having appeared in rebuttal , and stated that he would like to address some of the issues that had been brought up during the course of the hearing process , and advised that the lot sizes for this project should not be compared to the lot sizes of the existing neighborhood in that the proposed development was of a more modern design and structure than the older homes in the existing neighborhood;, and Mr . Falender also having .addressed traffic concerns and having advised that contributions from this .project would be made for up-dating traffic signals , and having stated that this project complies with the City County Cooperative Land Use Plan , and is in harmony with the existing neighborhood, and having advised that this project is before the Board with a . recommendation for approval from the County Planning Staff , and a unanimous approval by the County Planning Commission , and having urged the Board to approve this project; and The Chairman having closed the public hearing, and advised that the issue was now before the Board for discussion; and Supervisor McPeak having recommended that the Environmental review process be further reviewed by staff, and stated that there was a considerable amount of Environmental Impact information before the Board at this time , and stated that if an item of process had been omitted that the Board needed to go back and rectify that pro- cess , and having stated that , in her opinion, it was important to have a discussion on this matter for the benefit of those people concerned with this project; and Supervisor McPeak , having advised that the lot sizes for this project were compatible with those that they will abutt , and having advised that this project was of a sensitive design that would be .consistent with and not impact on the surrounding areas , and having also stated that this project was not opposed by the City of Pleasant Hill , and also was approved unanimously by the Planning Commission; and Supervisor McPeak having recommended that the issue of the scenic corridor be addressed in the conditions of approval for this project; and Supervisor Fanden having expressed concerns regarding the increasing traffic circulation in this area; and Supervisor Schroder having commented that., in his opinion , this project was compatible with the surrounding area, and stated that he felt this was a commendable development , and recommended that the Board move forward on this project; and Supervisor Torlakson having advised that he would support a motion in favor of this project; and Supervisor McPeak having advised that she felt it was an important part of the hearing process to have the Board members discuss what was before them , and recommended that this matter be referred to County Counsel with respect to the California Environmental Quality Act process , for review , and set a specific date to make a decision on this project; and Board members having discussed the matter , IT IS ORDERED that the decision on rezoning application 2556-RZ and Preliminary Development Plan in the Pleasant Hill area is DEFERRED to May 22, 1984, at 2: 30 p.m. I hereby csrft that this is a true and correctcopy of an action taken and entered on the minutes of the Board of Supervisors on the date shown. � ATTESTED: J.R.
