NOES: None. ABSENT: None. ABSTAIN: None . SUBJECT: Determination of Property Tax .Transfer) For Subdivision 6406 Annexation to ). County Service Area L-42 (LAFC 84-15) ) RESOLUTION NO. 84/ 276 and Proposed Concurrent Detachment ) From County Service Area M-11 ) WHEREAS, Section 99. 1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not been pre- viously provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer except for the annexing district; and WHEREAS, Subdivision 6406 -Annexation to County Service Area L-42 (CSA L-42) ('LAFC 84-15) and the proposed concurrent detachment from County Service Area M-11 (:CSA M-11) involves annexation to CSA L-42 for which the property tax .exchange has been determined to be zero pursuant to Board of Supervisors Resolution No. 80/1464 regarding such annexations; and WHEREAS, the Local Agency Formation Commission Executive Officer has proposed that Subdivision 6406 Annexation to County Service Area L-42 (LAFC 84-15) be amended to become a reorganization consisting of the subject annexation and a concurrent detachment from County Service Area M-11. The detachment is being proposed because the territory involved (approximately one-fourth. of an acre). is owned by the East Bay Municipal Utility District and does not generate revenue for nor receive services from CSA M-11. NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of Contra Costa County does hereby determine that 100% of any property tax accruing to CSA M-11 from the affected territory of the proposed detachment shall be transferred to Contra Costa County if the Local Agency Formation Commission amends Subdivision 6406 Annexation to CSA L-42 (_LAFC 84-15� as discussed above. This resolution does not change the property tax revenues accruing to other agencies serving the subject territory orth.e affected districts ' right to collect taxes for existing bonded indebtedness. The property tax exchange agreement discussed above shall apply to affected territory as submitted or revised by the Local Agency Formation Commission.
