HomeMy WebLinkAboutMINUTES - 05221984 - T.7 7- 7 t THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA r " Adopted this Order on May 22, 1984 , by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak, Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: Hearing on recommendation of County Planning Commission with respect to rezoning application 2575-RZ and Preliminary Development Plan filed by Harvey C. Wong (applicant and owner) , to rezone land in the E1 Sobrante area. This being the time fixed for hearing on the recommen- dation of the County Planning Commission with respect to rezoning application 2575-RZ and Preliminary Development Plan to rezone 5. 07 acres of land from Multiple Family Residential District (M-12 and M-29) to Planned Unit District (P-1) and approval of a Preliminary Development Plan for a Townhouse Development (in two phases) , in the E1 Sobrante area; and Harvey Bragdon, Assistant Director of Planning, having described the property site and having advised that a Negative Declaration of Environmental Significance was filed for the project; and The Chairman having opened the public hearing; and Roger Glafke , 4361 Santa Rita Road, El Sobrante, having appeared and requested that the applicant be required to construct a cyclone fence along the common boundary line of the property in order to prevent children from getting on his property because of the dangers of horses which were kept on his property; and Supervisor Fanden having inquired as to whether the issue of fencing was brought up at the Planning Commission; and Roger Glafke having stated that at the Planning Commission hearing he was advised that he could not legally reguest fencing from the Planning Commission; and Mel Hagen, 4365 Santa Rita Road, E1 Sobrante, having appeared and expressed his concerns regarding fencing and fire safety, for this project, and also voiced concerns regarding traf- fic, and recommended that Appian Way be improved in order to handle increased traffic which would be generated from this project; and Heston Chau, Architect, representing Harvey Wong, appeared and advised the Board that the applicant was taking fire safety issues into consideration, and also advised that Harvey Wong, the applicant was prepared to install a six-foot high wood fence for esthetic reasons, but was not in agreement to installing a cyclone fence with barbed wire at the top; and The Chairman having closed the public hearing; and Supervisor Powers having recommended that the Board approve rezoning application 2575-RZ and strengthen the condition regarding the fencing for this project so that it would reguire a sturdy fence that would prevent, as best as possible , children from climbing over on to the Glafke' s property; and Z- a 1 Board members having considered the matter , IT IS ORDERED that rezoning application 2575-RZ, with the recommendation of Supervisor Powers, and a Preliminary Development Plan is APPROVED, subject to conditions imposed by the Planning Commission as set forth in Exhibit A attached hereto and by reference incorporated herein, and the Board hereby adopts the Planning Commission' s reasons, set forth in its Resolution number 27-1984 as its deter- minations for this decision. Wong all- u i V MM n CONDITIONS OF APPROVAL OF 2575-RZ: J 1. This approval is based upon the exhibits received by the Planning Department and listed as follows: A. Exhibit "A" - Preliminary Development Plan, Appian Meadows, scale 1" = 30', received December 20, 1983. B. Exhibit "B" - Preliminary landscape plan, received December 20, 1983. C. Exhibit "C" - Preliminary elevations and floor plans received December 20, 1983. 2. The number of units shall not exceed 55. The development shall be subject to further review with the final development plan which may result in a different number of units being approved. The conditions of this approval serve to give the applicant directions in the preparation of the final development plan, a revised plan shall be submitted giving consideration to the following: A. Final plan and perspective showing some staggering of building fronts, additional guest parking and road and sidewalk details. B. Final landscape plan showing landscaping details, fencing details, tot lot details and recreation area and building details. Heavy landscaping shall be provided along the sites frontage on Appian Way. C. Final elevation and floor plans for the units as well as the recreation building. 4. Sewage disposal serving the properties concerned in this application shall be provided by the West Contra Costa Sanitary District. Each individual living unit shall be served by a separate sewer connection. The sewers located within the boundaries of the properties concerned should become an integral part of the Central Contra Costa County Sanitary District's sewerage collection system. 5. Water supply serving the properties concerned shall be by the East Bay Municipal Utility District. Such water distribution system, located within the boundaries of the properties concerned in this application, should become an integral part of the East Bay Municipal Utility District's overall water distribution system. Each individual living unit shall be served by a separate water connection. 6. Comply with the requirements of the West County Fire District including provision for water supply and firehydrants, as determined by the District. 7. A preliminary draft for Covenants, Conditions & Restrictions (CC&Rs) shall be submitted with the Final Development Plan. This document shall provide for establishment, ownership and maintenance of the common open space and parking, fire protection, fencing, private streets and drainage maintenance. 8. The Covenants, Conditions & Restrictions (CC&Rs) developed for this project shall include the following deed restrictions: Oo �` 2575-RZ Page 2 A. No recreational vehicle, boat trailer or mobile home shall be stored on the site overnight. 9. Each unit shall have address numbers that are clearly visable to the street day and night. 10. Comply with the requirements of the Public Works Department as follows: A. A final development plan or tentative map is subject to the requirements of Titles 9 and 10 of the County Ordinance Code and the following: 1. Interior roadways shall be constructed to minimum County Private Road Standards. 2. Consideration will be given to providing access rights to the easterly property. Such rights would be activated upon executior of a cross easement agreement. B. Comply with the acreage fee requirements for Drainage Area 73 as adopted by the Board of Supervisors. ' C. Mitigate the impacts of traffic from this development (at the time of the development permit or tentative map approval) by: 1. Participating in offsite road improvements on the Appian Way corridor equivalent to $1,300 per unit. Participation in offsite improvements will be credited toward road fees adopted by the Board of Supervisors. Q0
