THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on MaY 1, 1984_ by the following vote:
AYES: Supervisors Fanden, Schroder, Torlakson
NOES: None
ABSENT: Supervisors Powers, McPeak
ABSTAIN: None
SUBJECT: Hearing on recommendation of the San Ramon Valley Area
Planning Commission with respect to rezoning application
2586-RZ filed by Max and Janet Hale to rezone land in the
Danville area.
This being the time fixed for hearing on the recommen-
dation of the San Ramon Valley Area Planning Commission with respect
to rezoning application 2586-RZ to rezone approximately 3. 25 acres
from General Agricultural District (A-2) to Single Family
Residential District (R-20) , in the Danville area; and
Harvey Bragdon, Assistant Director of Planning, having
described the property site and having advised that a negative
Declaration of Environmental Significance was filed for this
proposal; and
The Chairman having opened the public hearing; and
Earl Walker, 95 Park Meadow Court, Danville, representing
the White Gate Homeowners Association, having appeared and stated
that the White Gate Homeowners Association had no complaints with
the subdividing of this land, and stated that he felt .this was an
appropriate and reasonable use of the land, which was compatible
with the surrounding neighborhood, but expressed the Homeowner
Association' s opposition to the keeping of horses on these parcels,
and requested that the Board approve the Single Family Residential
District (R-20) zoning, but because of the special nature of the
area, requested the Board to add a condition to both parcels of land
which would specifically disallow the keeping of horses on the
property; and
Mr. Vincent Scotto, 1874 Green Valley Road, Danville,
representing the Homeowners Association of Green Valley, having
stated that the Homeowners Association of Green Valley had approved
the rezoning, but requested that a condition be added to restrict
horses, and expressed his concern with respect to the creek in the
neighboring area, which he felt would be destroyed if horses were
allowed on this property; and
Gene DeBolt, representing the applicant, having appeared
and stated that the property owner would like to retain his right
to have horses because he has always had that right, and further
stated that developments occuring around his property have been
aware of that, and also stated that in his opinion this property was
consistent with that of the surrounding neighborhood; and
Supervisor Torlakson having inquired as to which parcel
horses would be kept on, if the owners desired to have horses on
this property, and as to whether there would be fencing around the
parcel to keep the horses from entering the creek; and
Gene DeBolt advised that the larger parcel would be the
one most likely to have horses, and also advised that to control the
horses the owner would have to construct a fence around that parcel;
and
The Chairman having closed the public hearing; and

Supervisor Schroder having commented that he understood
the concerns of those individuals who did not have horses, and the
problems that horses could cause when the facilities were not main-
tained in the proper manner, but also stated that he did not feel
that it would be consistent or proper to exclude the horse keeping .

approve rezoning application 2586-RZ,
Board members having discussed the matter, IT IS ORDERED
that rezoning application 2586-RZ filed by Max and Janet Hale to
rezone land in the Danvile area is APPROVED, and the Board hereby
adopts the San Ramon Valley Area Planning Commission' s reasons, set
forth in Resolution Number 18-1984 (SR) , as its determinations for
this decision:
IT IS FURTHER ORDERED that Ordinance Number 84-20 giving
effect to the aforesaid rezoning is INTRODUCED, reading waived and
May 15, 1984, is set for adoption of same.
