R. Lucas (applicant) , and Aldo P. Guidotti (owner) , from Orinda Area Planning Commission denial of Development Plan #3054-83 for an office building with variance to allow a zero-foot setback for a sign, in the Orinda area. The Board on April 17, 1984, having closed the public hearing and deferred decision to this date on the appeal of J. R. Lucas (applicant) , and Aldo P. Guidotti (owner) , from Orinda Area Planning Commission denial of Development Plan #3054-83 for an office building with variance to allow a zero foot setback for a sign, in the Orinda area; and Supervisor Torlakson having advised that he had received a request to speak before the Board by Mr. J. R. Lucas and also advised that the public hearing had .been closed on April 17, 1984; and Supervisor Fanden having advised that she would like to have Mr. J. R. Lucas speak, if that was agreeable with the other Board members; and Mr . J. R. Lucas having appeared and advised that the request he was making was for a decision to allow the driveway to run between the two structures, and also stated that Mr. Guidotti had specific reasons for this request; and inquired as to whether he could address that issue; and Victor Westman, County Cousel, advised the Board members that if they wished to receive further testimony it would be necessary to further notice the hearing; and Supervisor Fanden having commented that the driveway for this project has been the major problem, and suggested that this matter be referred back to the Orinda Area Planning Commission, and that the Orinda Area Planning Commission be requested to make an immediate decision on Development Plan #3054-83 for an office building with variance to allow a zero-foot setback for a sign in the Orinda area; and Mr . Lucas having requested the Board to make a decision on Development Plan #3054-83 at this time; and Harvey Bragdon, Assistant Director of Planning having i advised that the driveway has been the problem, the Orinda Area Planning Commission did not like the driveway. going between the two structures, and felt that the driveway going around the structures did have some merit, and advised that if the Board desired to approve the Plan with the driveway going around the structures then it would be the recommendation of the Planning Department to have the Board declare its intent to approve the Development Plan with the driveway going around the structures. a® 259 i � _ I Board members having discussed the matter, IT IS ORDERED that the appeal of J. R. Lucas (applicant) and Aldo P. Guidotti I I I 00 26►9 Exhibit A CONDITIONS OF APPROVAL FOR DEVELOPMENT PLAN 3054-83: 1. The application for a development plan. is approved subject to plan Version #5 submitted and dated received May 1, 1984. 2. Prior to occupancy of the new structure all landscaping shall be installed, all site improvements completed and the improvements to the existing structure completed. 3. All mechanical equipment shall be installed inside the new structure. Mechanical equipment at the rear of the existing structure shall be enclosed. 4. The existing structure shall be remodeled on the exterior to provide a structure compatible with the new structure in style, materials and colors. Elevations and exterior materials and colors are subject to review and approval by the Zoning Administrator. 5. The area between the existing structure and proposed structure shall be developed as an outdoor seating and lunch area for employees. Plans for the development shall be included in Final Landscape Plans which shall be submitted for the review and approval of the Zoning Administrator prior to issuance-of a building permit. All landscaping shall be irrigated. 6. Prior to issuance of a building permit applicant shall submit drainage and grading plans for the review and approval of Cal Trans. . 7. Applicant shall provide a sprinkler system for the new structure, fire alarms for the existing structure and a turning radius of 31.5 feet in the parking lot. Prior to request for a building permit applicant shall submit the plans to the Orinda Fire District. 8. One (1) fire hydrant shall be provided capable of supplying 1000 GPM with location to be determined by East Bay Municipal Utility District and Orinda Fire District before issuance of building permits. Cost of installation shall be borne by the . owner/developer. 9. Comply with the requirements of the County Building Inspection Department as follows: A. A grading permit may be required if earthwork is necessary to develop Lot 66 of Tract 2245 for the office complex. B. The plans accompanying the application for building permits shall show the existing contours, the extent of the proposed grading and drainage improve- ments, and be reviewed by the Grading Section prior to issuance. C. Prior to the issuance of building and/or grading permits in the above develop- ment plan a preliminary soil investigation report, prepared by a licensed soil engineer will be required. It shall report on the ability of the site to support the improvements anticipated, and shall include recommended foundations designs to achieve maximum stability of the proposed structures. A licensed soil engineer may be required to control grading operations and to report on the ability of the site to support the improvements anticipated if a grading permit is required. E. The depth and location of any unengineered fill on Lot 66, Tract 2245 shall be indicated on the plans accompanying the application for building permit for the office complex. F. Lot 66 Tract 2245 must accept all surface waters which now flow to the lots and all water flowing from the lot must be directed to an existing adequate storm drainage facility. Storm water run-off is not to be directed to the State of California Road Right-of-Way without explicit written permission from State of Calif ornia,Transportation Agency. 10. Applicant shall provide noise attenuation measures to assure that interior noise levels do not exceed 50 dBA (CNEL) and that the exterior noise levels on the southerly terrace six feet above floor level do not exceed 60 dBA (CNEL). 11. Applicant shall revise the parking lot configuration to provide one handicapped parking space near each entry on the new structure. The final size of the structure shall be determined by the available parking spaces. 12. Prior to issuance of building permits applicant shall provide verification of Cal Trans approval for the proposed off-site.landscaping. 13. Applicant shall consent to grant an easement to R-6 to allow for a continuous linkage of land for the .proposed bike trail connecting Orinda to Lafayette. Central Contra Costa Sanitary District shall review .and approve the proposed easement prior to recording. 14. Parking and circulation plans are subject to review and approval by the Zoning Administrator and the Orinda Fire Protection District. 15. Applicant .shall pursue development of a sidewalk and crosswalk to provide a pedestrian connection to the .downtown area. Improvements shall be completed prior to occupancy of the new structure. 16. All retaining walls are subject to review and approval by the Zoning Administrator. 17. .Comply with the requirements of Public Works Department as follows: A. Instal l ,t.root-. 1 iril,t.s on Bates Boulevard. The final number and location of the lights will be determined by the utility company and approved by the Traffic Engineer. Q. In accordance with Section 82-2.014 of the County Ordinance Code, this development shall conform to the requirements of `Division 914 (Drainage) of the Subdivision Ordinance. C. Prevent storm drainage, originating on the property and conveyed in aconcentrated manner, . from draining across the sidewalk or on driveways. D. Install all new utility distribution services underground. 00 262 3054-83 pg. 3 fJ E. Obtain an encroachment permit from the Public Works Department, Land Development Division, for placement of street lights, underground utilities, construction of driveways and .any other, improvements within the right of way of Bates Boulevard. F. Submit improvement plans prepared by a registered civil engineer to the Public Works Department, Land Development Division , for review; pay the inspection, plan review and applicable lighting fees. These plans shall include any necessary traffic signing and striping plans for review by the County Traffic Engineer. The improvement plans . shall be submitted to the Public Works Department, Land Development Division, prior to the issuance of any building permit. The review of improvement plans and. payment of all fees shall be completed prior to the clearance of any building for final inspection by the Public Works Department. If final inspection is requested prior to construction of improvements, the applicant shall execute a road improvement agreement with Contra Costa County and post the bonds required by the agreement to guarantee completion of the work.
