Adopted this Order on May 15, 1984 by the following vote:
AYES: Supervisors Powers, Schroder, McPeak, Torlakson
NOES: None
ABSENT: Supervisor Fanden
ABSTAIN: None
SUBJECT: Addition of East County Educational Facilities Plan
Component to the Community Facilities Element of the
County General Plan in East Conra Costa County.
This being the time for hearing on the recommendation of
the County Planning Commission on the proposed addition of the East
County Educational Facilities Plan Component to the Community
(Public) Facilities Element of the County General Plan for East
Contra Costa County; and
Mr. Anthony Dehaesus, Director of Planning, having
appeared and recommended that the Board adopt the plan and instruct
staff to proceed with implementation methods; and
Dr . Joyce Mandesian, Superintendent of Oaklev Union School
District, having appeared and introduced the presentation to be made
to the Board by the School Districts in East County; and
Dean Bettker , Superintendent of Liberty Union High Scbogl
District, having, presented a series of slides illustrating the:'
Planning Department' s projection of growth for the various schools
in East County, and the projected number of students for the various
schools through the year 2000, as well as, projected construction
costs, and having urged the Board to develop a financing plan for
the projected growth; and
The following persons having appeared in favor of the pro-
posed Plan with various modifications:
Charles Spears, County .Board of Education;
Julie Foreman, Oakley Parents' Club Oakley Middle School;
Leonard Gerry, Liberty Union High School District, School
Board member;
Timmothy Moffett, Oakley Union School District Board
member;
Louis T. Lozano, Attorney representing Oakley School
District and Liberty Union High School District; and
Eric Hasseltine, representing the Building Industries
Association, the Hofmann Company,. and other developers in the East
County area, having urged the Board to adopt the plan as recommended
by the County Planning staff; and
Supervisor Torlakson having advised that he had written
comments from Lorraine R. Morin, 4870 Burgundy Drive, Oakley 94561,
Issac R. Montanez, Principal of Garin Elementary School, Brentwood,
and Lisa A. Casentini, 4880 Burgundy Drive, Oakley 94561, urging a
solution to the school overcrowding problem;
The Chairman having declared the hearing closed;
Mr. Dehaesus having explained that the recommendations of
the County Planning Commission differed slightly from the recommen-
dations of the County Planning staff; and
Board members having discussed the various components of
the Plan in great detail, including the differences in the recommen-
dations of the Planning Commission and the Planning staff, whether
the funds currently collected under SB 201 are sufficient, the ade-
quacy of provisions for portable classrooms for immediate use, the
provision for an annual report from the school districts with
respect to mitigation actions such as boundary changes, open
enrollment and unification, possible use of a joint powers agreement
for formation of a community facilities district, and the concept of
a redevelopment agency; and
Supervisor Torlakson having moved to adopt the recommen-
dations of the County Planning Commission on the East County
Educational Facilities Plan, and Supervisor Schroder having seconded
the motion for the sake of discussion, and having recommended, as
Chairman of the Finance Committee, that if recommendations for the
implementation include utilization of any county general funds, that
those recommendations be directed through the Finance Committee for
review; and
Supervisor McPeak having requested the Director of
Planning to outline the reasons why the Planning Department Staff
has some different recommendations from the Planning Commission; and
Mr. Dehaesus having commented on the two changes that the
staff recommended to the Planning Commission' s resolution for the
plan component, as well as, changes to the second resolution dealing
with facility financing; and
Supervisor Torlakson having commented that he favored the
Commission' s recommendations with certain exceptions, and therefore
would like to modify the motion; and
Board members having further discussed the matter , and all
parties having agreed on the need for further clarification, the
motion and second were withdrawn; and
Supervisor Powers having requested that the Director of
Planning develop a resolution for the Board' s consideration on
May 22, 1984, to include the recommendations of the Planning
Commission and the Planning staff which the Board has indicated it
favors;
GOOD CAUSE APPEARING THEREFORE, the Board hereby DECLARES
its intent to adopt on May 22, 1984, at 2: 30 p.m. a resolution
approving the proposed East County Educational Facilities Plan
Component of the Community Facilities Element of the County General
Plan in East Contra Costa County with modifications of the recommen-
dations of the County Planning Commission and the County Planning
staff.
IT IS BY THE BOARD ORDERED that May 29, 1984, at 7: 00 p.m.
is FIXED to consider recommendations of the Director of Planning on
implementation of the infrastructure plan for the Oakley area.
IT IS FURTHER ORDERED that the question of financing said
Plan is REFERRED to the Finance Committee (Supervisors Schroder and
McPeak) .
IT IS FURTHER ORDERED that the concept of a task force to
pursue both the question of implementation of the infrastructure
plan and the question of necessary legislative efforts is REFERRED
to the Director of Planning for recommendation to either the
Internal Operations Committee (Supervisors Powers and Fanden) or to
the Board, whichever he deems appropriate.
IT IS FURTHER ORDERED that the Director of Planning is
REQUESTED to review the adequacy of the amount of SB 201 funds
currently collected and to furnish the Board with a report on same
by June 19, 1984.
