Sec. 1245 . 230 ) Project No. 7554-6D8424 ) 6 ) 7 The Board of Supervisors , as ex officio the Board of 8 Supervisors of the Contra Costa County Flood Control and Water 9 Conservation District , by vote of two-thirds or more of its mem- 10 bers , RESOLVES that : 11 Pursuant to West ' s Water , Code - Appendix, Sec. 63-5 and 12 Deering' s Water - Uncodified Acts , Act 1656 , Sec . 5, the Contra 13 Costa County Flood Control and Water Conservation District intends 14 to construct a drainage channel , a public improvement , and , in 15 connection therewith , acquire interests in certain real property. 16 The property to be acquired consists of two parcels and is 17 generally located in the Danville area approximately 300 feet 18 south of Verona Avenue . Said property is more particularly 19 described in Appendix "A" , attached hereto and incorporated herein 20 by this reference . 21 On April 24 , 1984 , this Board passed a resolution of intention 22 to adopt a resolution of necessity for the acquisition by eminent 23 domain of the property described in Appendix "A" (Resolution No. 24 84/238 ) and fixing May 15 , 1984 , in its Chambers in the 25 Administration Building, 651 Pine Street , Martinez, California, as 26 the time and place for the hearing thereon . 27 The hearing was held at that time and place , and all 28 00 128 1 interested parties were given an opportunity to be heard and based 2 upon the evidence presented to it , this Board finds , determines 3 and hereby declares the following: 4 1 . The public interest and necessity require the proposed 5 project ; 6 2 . The proposed project is planned and located in the manner 7 which will be most compatible with the greatest public good and 8 the least private injury; 9 3 . The property described herein is necessary for the pro- 10 posed project ; and 11 4 : The offer required by Section 7267 . 2 of the Government 12 Code was made to the owner of record . 13 The County Counsel of this County is hereby AUTHORIZED and 14 EMPOWERED: 15 To acquire in the District ' s name, by condemnation, the 16 titles , easements and rights of way hereinafter described in and 17 to said real property or interest ( s ) therein, in accordance with 18 the provisions for eminent domain in the Code of Civil Procedure 19 and the Constitution of California : Parcel 1227 is to be acquired 20 as a permanent drainage easement ; and parcel 1227T is to be 21 acquired as a temporary construction easement , which shall expire 22 on December 1 , 1984 ; 23 To prepare and prosecute in the District ' s name such pro- 24 ceedings in the proper court as are necessary for such 25 acquisition; and 26 To deposit the probable amount of compensation , based on an 27 appraisal , and to apply to said court for an order permitting the 28 -2- 00 129 I District to take immediate possession and use said real property 2 for said public uses and purposes . 3 PASSED and ADOPTED on - May 15,- 1984 --_-, by the following 4 vote: 5 AYES : Supervisors Powers , Fanden, Schroder, McPeak , Torlakson 6 NOES : None 7 ABSENT: None 8 I HEREBY CERTIFY that the foregoing resolution was duly and 9 regularly introduced , passed and adopted by the vote of two-thirds 10 or more of the Board of Supervisors of Contra Costa County, 11 California, as ex officio the Board of Supervisors of the Contra 12 Costa County Flood Control and Water Conservation District , at a 13 meeting of said Board on the date indicated . 14 15 Date : May 15 , 1984 J.R.OLSSON, County Clerk and 16 ex officio Clerk of the Board of Supervisors of Contra Costa 17 County, California 18 By: 19 .--- -------------- Deputy cc: Public Works Department , 20 Real Property Division Auditor-Controller 21 County Counsel (Certified copy) 22 OO.2 .DA107 .T5 23 24 25 26 27 -3- 28 00 130 DRAINAGE AREA 10, LINE A APPENDIX "A" PARCEL 1227 - SALVO - (Drainage Easement) A drainage easement described as follows: A portion of the Rancho San Ramon also being a portion of the Parcel of land described as Parcel Three in the deed to Martha Ann Salvo recorded June 49 1982 in Book 10802 at page 701 Official Records of Contra Costa County, Cali- fornia, described as follows: Beginning at the most westerly corner of said Salvo Parcel Three (10802 OR 701); thence from said point of beginning along the northwest line of said Salvo Parcel Three (10802 OR 701) North 360 55' 00" East 7.11 feet to a point which shall hereinafter be referred to as Point "A" ; thence leaving said northwest line South 420 48' 30" East 105.80 feet to a point on the southeast line of said Salvo Parcel Three (10802 OR 701) ; thence along said southeast line South 360 55' 00" West 7.11 feet to the southern most corner of said Salvo Parcel Three (10802 OR 701) ; thence along the southwest line of said Salvo Parcel Three (10802 OR 701) ; North 420 48' 30" West 105.80 feet to the Point of beginning. PARCEL 1227T - SALVO - (Temporary Construction Easement) A Temporary Construction Easement to expire December 1 , 1984, described as follows: Beginning at Point "A" described in Parcel 1227 above; thence from said Point "A" along the northwest line of said Parcel Three (10802 OR 701 ) North 36° 55' 00" East 3.05 feet; thence leaving said northwest line South 420 48' 30" East 105.80 feet to a point on the southeast line of said Salvo Parcel Three (10802 OR 701); thence along said southeast line South 360 55' 00" West 3.05 feet to the most easterly corner of Parcel 1227 above; thence from said easterly corner along the northeast line of said Parcel 1227 North 420 48' 30" West 105.80 feet to said Point "A" the point of beginning. 00 131 May 15 , 1984 CLOSED SESSION At 12 : 00 Noon the Board recessed to meet in Closed Session in Room 105 , County Administration Building, Martinez, California, to discuss personnel and litigation matters .
