SUBJECT: SUPPORT OF PROPOSITION 16 PROVIDING $250 MILLION IN STATE JAIL
CAPITAL, EXPENDITURE FUNDS
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
Recommendation
Support Proposition 16,on the June 1984 ballot,which provides $250 million (through the
sale of general obligation bonds) Statewide in Jail Capital Expenditure Funds.
Background
As a result of the Proposition 2 county jail application and review process, approximately
$1 billion of pressing county jail needs were identified throughout the State of California.
A needs assessment process was begun by a large number of counties as early as 1981 (with
the passage of AB 3245, which provided jail funds to a small number of counties) . The
assessment process continued under Proposition 2 when forty-seven counties submitted
applications to the State Board of Corrections. The Board of Corrections went through an
extensive review, and ranking process in the case of the 19 counties applying for large
projects. The Board of Corrections recommended funding 8 large projects and all small
projects, based on the limited amount of funds available ($280 million) . With the support
of the Legislature and the Governor, Proposition 16 was placed on the June 1984 ballot to help
address the remaining identified needs.
Assemblyman Richard Robinson has introduced AB 3805, which details the allocation by county
of Jail Capital Expenditure Funds that may be provided by Proposition 16 and other State
funds, based upon the Proposition 2 rankings and evaluation process. As you know, Contra
Costa County's application for jail funds was immediately below the funding line identified
by the Board of Corrections. The Robinson bill would guarantee funding to Contra Costa
County. Your Board on March 20, 1984 approved a Board Order supporting AB 3805. It should
be noted that the Robinson bill (AB 3805) represents a consensus plan arrived at by the
counties which submitted Proposition 2 applications. This consensus planning process was
sponsored and led by CSAC. The Assembly passed AB 3805 by an overwhelming vote and it is
now awaiting a hearing in the Senate Judiciary.
Without the passage of Proposition 16 by the voters, AB 3805 cannot be implemented and
Contra Costa County will, in all likelihood, not receive any funds to meet its need for a
new detention facility. It is unlikely that, should Proposition 16 fail, the Legislature
and Governor would utilize State General Fund money for that purpose.
We believe it consistent with your support of AB 3805 to support the passage of Proposition
16 on the June ballot.
